קיבל שאיר של עובד או שוטר, לרגל מות העובד או השוטר, הענקה מאוצר המדינה, או הענקה אשר אוצר המדינה השתתף במימונה, יחולו עליהם הסעיפים 1 עד 3 מיום תחילת החוק, אולם אם היה הדבר לטובת השאירים, יחולו עליהם הסעיפים האמורים מהחודש המתחיל אחרי יום הפרישה, ובלבד שההענקה האמורה תקוזז עם הגימלאות המגיעות.
