110לד. סמכויות קצין שיפוט בכיר הדן בערר
תיקון: תשס״ח־2, תשע״א
(א)קצין שיפוט בכיר הדן בערר רשאי –
(1)לקבל את הערר ולזכות את הנאשם או להרשיע את הנאשם ולגזור את דינו, לפי העניין;
(2)להקל בעונש;
(3)לדחות את הערר;
(4)להרשיע בעבירת משמעת אחרת, ובלבד שניתנה לנאשם הזדמנות סבירה להתגונן.
(ב)היה הערר על חיוב בתשלום פיצויים לפי סעיף 110סה, רשאי קצין השיפוט הבכיר הדן בערר לבטל את החיוב בתשלום או להפחית את שיעור הפיצויים.
