251. נכס הכפוף לשיור בעלות
נכס הכפוף לשיור בעלות הוא נכס שמתקיימים בו כל אלה:
(1)הנכס נמכר לחייב והועבר לחזקתו, לפני מתן הצו לפתיחת הליכים;
(2)הבעלות בנכס נותרה בידי המוכר, לפי הסכם המכירה, עד לתשלום התמורה בעדו;
(3)הוראות סעיף 2(ב) לחוק המשכון, לא חלות על עסקת המכר.
