3. הכרזה כי חייב הוא חדל פירעון
(א)הוכרז, בצו, כי חייב הוא חדל פירעון וכי ייפתחו לגביו הליכי חדלות פירעון לפי חוק זה (בחוק זה – צו לפתיחת הליכים), יוסדרו יחסיו של החייב עם נושיו, במאוחד, בהתאם להוראות לפי חוק זה, עד לסיום הליכי חדלות הפירעון.
(ב)פתיחה בהליכי חדלות פירעון לגבי חייב שהוא חדל פירעון תהיה ביוזמת החייב, הנושה או היועץ המשפטי לממשלה.
