79. בקשת נושה
(א)בקשת נושה לצו לפתיחת הליכים לגבי יחיד תוגש לבית המשפט ערוכה לפי טופס 9 שבתוספת; הנושה יצרף לבקשה אסמכתאות לכך שהתקיימו העילות למתן הצו.
(ב)ביקש הנושה להסתמך בבקשתו על חזקת חדלות פירעון לפי סעיף 110(א) לחוק, יצרף לבקשה אסמכתאות מתאימות לקיומה של החזקה, לפי העניין.
