434. שמיעת ערעור שלא בפני בעלי הדין כשהוטל מאסר שנה או עונש קל מזה
היה הערעור על פסק דין המטיל עונש מאסר של שנה או עונש קל מזה, ישמע בית הדין את הערעור, על אף האמור בסעיף 430, שלא בפני בעלי הדין אלא על סמך החומר שהובא לפניו בכתב בלבד; בית הדין יורה על שמיעת בעלי הדין אם ביקש זאת אחד הצדדים, או אם הוא סבור, לאחר עיון בחומר שבכתב, שהדבר דרוש לעשיית משפט צדק.
