328. סעיף 328
ההורג בכוונה ייענש בעונש מוות, אם ביצע את המעשה:–
(1)בכוונה תחילה (מעשה זה יקרא ”רצח בכוונה תחילה“);
(2)כהכנה לעשיית פשע, או כהקלה לעשייתו או בצועו או כדי להקל על בריחת המסיתים לפשע זה או בריחת מבצעי הפשע או המתערבים בעשייתו, או כדי לאפשר להם להתחמק מעונשים;
(3)אם העבריין בצע את הפשע נגד אחד מהוריו.
