426. סעיף 426
(1)העוונות שצוינו בסעיפים (415, 416, 422, 424 ו־425) לא ינקטו את ההליכים המשפטיים אלא על־פי תלונת הניזוק פרט למקרה של אלמוניות הניזוק.
(2)השימוש לרעה בנאמנות, והצפוי לעונש בהתאם לסעיף (422) מחייב מאליו נקיטת הליכים אם נלווה אליו אחד המקרים המחמירים שצוינו בסעיף (423).
