92. סעיף 92
(1)לא ישא אדם באחריות פלילית בשל מעשה או מחדל אם בשעת עשותו או אי־עשותו את המעשה היה בלתי כשיר להבין את אשר עשה, או לדעת שאסור היה לו לעשות את המעשה או המחדל מחמת מחלה שפגעה בצלילות דעתו.
(2)מי ששוחרר מהעונש על־פי סעיף קטן (1) יוסגר בבית חולים לחולי רוח עד שיוכח על ידי דו״ח ועדה רפואית על החלמתו ועל אי סיכונו לבטחון הציבור.
