2. מועד להגשת תובענה של מעביד בהעדר תובענה של עובד
תיקון: תש״ע
תובענה של מעביד, בשם עובד או התלוי בו, לגמלה לפי פרק ה׳ לחוק, כאמור בסעיף 393 לחוק, תוגש לבית הדין לעבודה בתוך שניים עשר חודשים מתום המועד להגשת התובענה על ידי העובד או התלויים כאמור בתקנה 1(ב), או מהיום שבו מסר המוסד הודעה למעביד על דחיית תביעתם של העובד או התלויים, הכל לפי המאוחר יותר.
