274. חישוב התגמול במקרים מיוחדים
[127עב]
(א)לענין חישוב שכר העבודה הרגיל או ההכנסה הממוצעת יראו אדם שבתכוף לפני שירותו במילואים לא היה עובד או עובד עצמאי, אך ההפסקה בעיסוקו לא עלתה על התקופה שנקבעה לכך, כאילו החל את שירותו במילואים ביום שחדל להיות עובד או עובד עצמאי, לפי הענין.
(ב)עובד הזכאי לתגמול גם כעובד עצמאי, לא יעלה סכום התגמול ליום, שישולם לו, על התגמול המרבי לעובד עצמאי.
