5. מי שחדל להיות עובד עצמאי

עובד עצמאי שהיה למבוטח שאינו עובד ואינו עובד עצמאי ייחשב כעובד עצמאי עד ליום שבו הודיע הוא למוסד, או שהמוסד הודיע לו בדואר או במסירה אישית אף שלא בדואר, על היותו למבוטח כאמור; ואולם רשאי המוסד, לפי שיקול דעתו ולבקשת העובד העצמאי או הזכאי לגמלה מכוחו, לראותו כעובד עצמאי או כמבוטח שאינו עובד ואינו עובד עצמאי למרות ההודעה האמורה או אף בהעדרה.
