פסק-דין

אנו נותנים תוקף של פסק דין להסדר אליו הגיעו הצדדים המסומן באות א'.

ניתן היום, ח' אדר, תשס"ז (26.2.2007).

הצדדים הגיעו להסכם סופו ומוחלט לסיום כל הטענות ביניהם מכל מין וסוג שהוא בעניין המגרש דלהלן:

1.תמורת מגרש בגוש 3900 חלקה 19, מגרש 220 ב', ישולם סך של 130,000$ לפי שער יציג.

2.השתתפות המערערים במס שבח היא 50% מהמס החל אך לא יעלה ע"ס 7500$. השתתפות המערערים במס מכירה 50% אך לא יותר מ-1000$.

3.כב' בית המשפט יורה על שחרור כל הערבויות והפקדונות שהופקדו בבית המשפט המחוזי ובבית המשפט העליון והכספים יוחזרו למערערים.

4.המשיבים ימסרו לידי המערערים את כל המסמכים, התכניות הקשורות למגרש הנמכר לידי המערערים במעמד חתימת חוזה המכר. וכן כל אישורי התשלום ששולמו בגין עבודות בניה ופיתוח.

5.בין הצדדים ייחתם חוזה מכר על בסיס האמור לעיל, והצדדים ישתפו ביניהם פעולה ויחתמו על כל המסמכים הדרושים לקיום העיסקה ולהעברתה ע"ש המערערים בלשכת רישום המקרקעין וזאת תוך 7 ימים מהיום.

6.בית המשפט יורה על רישום הערת אזהרה בלשכת רישום המקרקעין כדי להבטיח זכויות הקונים. המערערים ימציאו למשיבים יפויי כוח בלתי חוזר שיופקד בידי ב"כ המשיבים אשר מאפשר לו להשתמש בו למחיקת הערת האזהרה במידה והמערערים לא ישלמו את התמורה.

7.סכום התמורה ישולם בשישה תשלומים, שליש עם חתימת החוזה, שליש כעבור 50 יום, והשליש השלישי עם העברת הנכס בלשכת רישום המקרקעין ומסירת כל האישורים והמסמכים הדרושים להעברה ע"ש המערערים או ע"ש מי שהם יורו.
