פסק-דין
1.המשיבה הגישה לבית המשפט המחוזי בתל-אביב-יפו בקשה לאשר תובענה ייצוגית. בבקשה נטען כי המערערת גובה ארנונה בגין גלריות בנכסים שאינם למגורים, אף שעל פי הדין אין היא זכאית לגבות ארנונה כאמור. המערערת מסרה הודעת חדילה. לפיכך הסוגיה שנותרה להכרעה הייתה שיעור הגמול ושכר הטרחה שיש לפסוק לזכות התובעת הייצוגית ולפרקליטיה. בית המשפט (כבוד השופטת י' שטופמן) חייב את המערערת לשלם גמול בסך 75,000 ש"ח; שכר טרחה בסך 250,000 ש"ח והוצאות בסכום של 10,000 ש"ח. הערעור מופנה נגד שיעורם של הסכומים שנפסקו. לטענת המערערת ראוי היה לפסוק סכומים נמוכים בהרבה מאלה שנפסקו.
2.דעתנו היא כי אכן הסכומים שקצב בית משפט קמא גבוהים יתר על המידה. בין בעלות הדין נטושה מחלוקת באשר לסכום המצטבר שנחסך על ידי המחזיקים בנכסים בעקבות הודעת החדילה. המערערת טוענת שמ דובר בסכום כולל של מאות אלפי שקלים ואילו המשיבה טוענת כי מ דובר בסכום גבוה בהרבה. בנסיבות העניין אכן קשה להעריך בכמה נכסים מ דובר. יש לזכור שעסקינן בנכסים שאינם למגורים שיש בהם גלריה (בלא מתקן קבוע המאפשר להגיע לגלריה).
3.בנותנו דעתנו לקושי האמור ובהתחשב בטיעונים שהוצגו לנו, הננו בדעה שיש לקבל את הערעור ולקבוע כי אלה הסכומים:
א) גמול – 25,000 ש"ח (תחת 75,000 ש"ח).
ב) שכר טרחה – 100,000 ש"ח (תחת 250,000 ש"ח).
לא יחול שינוי לגבי סכום ההוצאות (10,000 ש"ח).
המשיבה תישא בשכר טרחה בסך 10,000 ש"ח בערעור. מאחר שהסכום שפסק בית משפט קמא שולם על ידי המערערת, על המשיבה להשיב את ההפרש בצירוף הפרשי הצמדה וריבית מיום התשלום ועד להשבה.
ניתן היום, ו' בטבת התשע"ד (9.12.2013), בנוכחות באי כוח בעלות הדין.
