הנשיא א' גרוניס:

1.בית המשפט לענינים מינהליים בתל-אביב-יפו (כבוד השופטת ד"ר מ' אגמון-גונן) דחה בהחלטה טענה של המערערת, רשות המיסים, לפיה אין לו סמכות מקומית לדון בעתירה שהוגשה על ידי המשיבים. בפסק-הדין, שקיבל את העתירה, ציווה בית המשפט על רשות המיסים ליתן מידע לגבי החברות שקיבלו הטבות מס לפי החוק לעידוד השקעות הון, התשי"ט-1959, בשנים 2012-2006, וכן לגלות את שמותיהן של עשר החברות שקיבלו את הטבות המס הגבוהות ביותר בכל אחת מן השנים הנזכרות, ואת גובה ההטבות.

2.מתברר, כי כיום אין רשות המיסים מתנגדת לחשוף את שמות החברות שקיבלו הטבות מס בשנים הנזכרות, וכן פרטים לגבי החברות הציבוריות שקיבלו את ההטבות הגבוהות ביותר מתוך העשר שבראש הרשימה ואף המציאה פרטים אלה. משמע, היקפו של הערעור צומצם במידה ניכרת.

3.החלפנו דברים עם פרקליטיהם של הצדדים לערעור. זאת, בין היתר משום שסברנו כי נפלה שגגה מתחת עטו של בית משפט קמא שעה שדחה את טענת המערערת בדבר היעדר סמכות מקומית לדון בהליך. מאחר שההחלטה עליה השיגו המשיבים ניתנה על ידי רשות מינהלית שמקומה בירושלים, חובה הייתה להגיש את העתירה לבית המשפט לענינים מינהליים בירושלים. משהועלתה טענה בעניין על ידי המערערת, ומאחר שהטענה הייתה נכונה, מוטל היה על בית המשפט בתל-אביב-יפו להעביר את ההליך לבית המשפט בירושלים.

4.בנסיבות העניין ולאחר שהתברר כי רשות המיסים ביצעה למעשה חלק ניכר מפסק-הדין, נראה לנו, בהתחשב אף בהסכמה של הרשות, שיש לפעול כדלקמן:

א. רשות המיסים תפנה תוך 30 ימים לחברות הפרטיות הרלוונטיות ותודיען על כך שהיא נדרשה על ידי המשיבים להמציא את שמותיהן. הרשות תיתן לחברות אפשרות להגיב, תוך 45 ימים, לדרישה לגילוי זהותן.

ב. לאחר קבלת העמדות של החברות תקבל הרשות החלטה תוך 60 ימים בעניין ותודיע דבר החלטתה למשיבים ולחברות הרלוונטיות.

ג. היה והמשיבים לא יהיו מרוצים מן ההחלטה פתוחה בפניהם הדרך להגיש עתירה לבית המשפט המוסמך (אף ככל שמ דובר בסמכות המקומית).

ד. אם אכן תוגש עתירה כאמור יהא צורך לקבוע כללים מיוחדים לניהול ההליך בלא שתיחשף זהותן של החברות.

נעיר עוד כי על בית משפט הדן בעתירה דוגמת זו שהגישו המשיבים, לתת דעתו אף לסעיף 17(ג) לחוק חופש המידע, התשנ"ח-1998. סעיף זה קובע שבית המשפט לא יורה על מסירת מידע העלול לפגוע במי שאינו בעל דין, היינו צד שלישי, אלא לאחר שנתן לו הזדמנות להשמיע טענותיו.

5.לפיכך הערעור מתקבל במובן זה שההחלטה בעניין הסמכות המקומית מבוטלת, כמו גם פסק-הדין (בין היתר לאור אי עמידה באמור בסעיף 17(ג) לחוק). עם זאת, נוכח העמדה הנוכחית של רשות המיסים, ברור שאין היא יכולה לחזור בה ממה שנעשה בעקבות פסק-הדין. כל זאת בכפוף לאמור בפיסקה 4 לעיל. החיוב בהוצאות שהשית בית משפט קמא מבוטל.
