הצדדים הסמיכו את בית המשפט לפסוק על דרך הפשרה לפי סעיף 79א לחוק בתי המשפט [נוסח משולב], התשמ"ד- 1984.

לאחר ששמענו את טיעוני הצדדים אנו פוסקים כי השטח לו זכאי המשיב הוא 680 מ"ר, כך שבחלק האופרטיבי של פסק הדין בעמוד 132 בשורה החמישית, במקום המילים "לאור האמור, זכאי התובע להירשם כבעלים של 997/5675 חלקים בחלקה 50 הנ"ל" ייכתב "לאור האמור, זכאי התובע להירשם כבעלים של 680/5675 חלקים בחלקה 50 הנ"ל" .

יתר חלקי פסק הדין יישארו על כנם.
