באי כוח הצדדים דיווחו כי הגיעו להסכמה כלהלן:

1.הזכויות בבית נשוא הערעור בע"א 1626/11 המהוות חלק מחלקה 20 בגוש 13990 והמסומנת כמגרש מספר 3 בתשריט המסומן א' והמצ"ב (להלן: בית ברש) יישארו רשומים על שם המערער בנימין ברש, תוך שניתנת הסכמה מראש של המשיבה בשמת שר למחיקת הערת האזהרה הרשומה לזכותה על בית ברש כהגדרתו לעיל (לפי שטר מספר 7434/0001 מיום 8.4.08).

2.הערת האזהרה תמחק במועד עריכת הסכם המכירה של בית ברש וזאת מכח פסק דין אשר ייתן תוקף להסכם זה.

3.באי כח הצדדים עורכי הדין בן פורת ושפר ימונו ככונסי נכסים למכירת בית ברש.

4.מכירת הבית תתבצע בתוך 6 חודשים ממועד מתן תוקף של פסק דין להסכם זה.

5.מתוך סכום התמורה למכירת בית ברש, לאחר ניכוי אגרות, היטלים והוצאות למעט ארנונה, אם יהיו, יקבל המערער (בנימין ברש) סכום של 612,000 ₪ ללא הצמדה וריבית ויתרת סכום התמורה תועבר למשיבה בשמת שר.

6.מתוך החלק של המשיבה בסכום התמורה ישולמו כל חובות הארנונה למועצה המקומית התלויים ועומדים לגבי בית ברש, כולל מיסי הארנונה עד למועד המכירה של בית ברש.

7.כמו כן, הנתבעים 1 ו-2 בת"א 525/06 ו-5656 נשוא ע"א 3487/11 (ה"ה חגי ואנדריאה כובש) ישלמו למר ברש פיצוי בגין עגמת נפש בסך של 70,000 ₪, וכן סך של 25,000 ₪ כתמורה לקרקע החקלאית הצמודה לבית כובש והמסומנת א' בתשריט המצורף (שטח של 1000 מטר). זאת בתוך 45 ימים ממועד מתן תוקף של פסק דין להסכם זה. ככל שעל התמורה בגין הקרקע החקלאית יחולו מיסים, כל צד ישא בהם על פי דין.

8.הקביעות בפסק הדין של בית המשפט קמא לגבי חיובי המיסים עבור רכישת בית כובש כמסומן 5 בתשריט המצורף, ישארו בתוקפם.

9.עם קיום שלם ובמועד של הסכם זה לא יהיו למי מהצדדים תביעות, דרישות וטענות כלשהן כלפי משנהו (הכוונה לכל הצדדים בכל הערעורים).

10.הצדדים ישתפו פעולה אחד עם השני. כל צד יחתום על המסמכים הנדרשים לרבות יפויי כח בלתי חוזרים. המסמכים יופקדו בנאמנות בידי כונסי הנכסים או יתר עורכי הדין.

11.סכום הפקדון בערעורים יוחזר למר בנימין ברש.

12.כל צד ישא בהוצאותיו.

13.בית המשפט מתבקש לתת תוקף של פסק דין.

פסק-דין

אנו מאשרים הסכם הפשרה אליו הגיעו הצדדים, ונותנים לו תוקף של פסק דין.
