פסק-דין

בהמלצתנו, באו הצדדים לכלל הסכמה ובמסגרתה אנו דוחים את הערעור על כל חלקיו, למעט עניין אחד והוא נוגע לתשלום שתחוייב בו המשיבה בגין "קטע א'". לעניין זה יוחזר הדיון לבית-המשפט המחוזי שישמע ראיות, כאשר מוסכם על הצדדים כי קטע א' הוא כהגדרתו בתצהיר העדות שניתן על-ידי המשיבה לבית-המשפט המחוזי, דהיינו, 28.5 מטר, וכי התשלום יעשה על-פי הקריטריונים של משרד הבינוי והשיכון כפי שיוכחו בשלב השני של המשפט כשהם משוערכים ליום פסק-הדין שיינתן.
