פסק-דין

1.ערעור על החלטת בית המשפט המחוזי בתל אביב-יפו (כבוד השופטת ד' קרת-מאיר), מיום 1.1.2014, שלא לפסול עצמו מלדון בפר"ק 1011/00.

2.התיק שבמסגרתו הוגשה בקשת הפסלות נושא הערעור דנא הוא תיק מורכב במסגרתו התקיימו הליכים רבים בעניין חדלות פירעון של שתי חברות: שיכון אזרחי בע"מ, היא המערערת 2 (להלן: שיכון אזרחי) ודיור לעולה בע"מ (להלן: דיור לעולה). בית המשפט דן בתיק למעלה מ-10 שנים. ביום 29.6.2000 נחתם הסכם בין המערערים ובין המשיב 1 בתפקידו כמפרק זמני של דיור לעולה, לבין חברת מ' מגן אינטרנשיונל חברה לבניין והשקעות בע"מ (להלן: המשקיע). ההסכם נחתם במסגרת הסדר נושים בעניינה של דיור לעולה (להלן: ההסכם ו הסדר הנושים, בהתאמה). ביום 12.7.2000 אושר הסדר נושים והמשיבים 1 ו-2 (להלן: המשיבים) מונו לכונסי נכסים על נכס מקרקעין שהיה שייך לשיכון אזרחי.

3.המערערים הגישו בקשה למתן הוראות לעריכת חשבון וביצוע בדיקה על ידי מומחה חיצוני. בבקשה טענו כי על המשיבים להשיב להם כ-9 מליון ש"ח על פי הוראות ההסכם והסדר הנושים. המשיבים ביקשו לדחות את הבקשה על הסף, בין היתר, בשל הפטר שנכלל, לפי הטענה, בהסכם שקיבל תוקף של החלטה ביום 24.8.2010 (להלן: ההחלטה). לטענתם, על פי ההסכם שקיבל תוקף בהחלטה, המשיבים פטורים מכל טענה כלפיהם בגין ביצוע תפקידם. המשיבים טענו כי הפטר זה ניתן בהסכמת המערער 1 בתמורה למחילה על יתרת חובו בסך של 2.7 מליון ש"ח. המערערים הגישו תשובתם לתגובת המשיבים. ביום 2.12.2013 הגישו המערערים בקשה לפסילת בית המשפט. בבקשתם, טענו המערערים כי מאחר שטענת המשיבים נוגעת לניסוחה ולפרשנותה של ההחלטה, לא יהיה זה ראוי שאותו שופט שנתן את ההחלטה ינקוט עמדה ביחס לפרשנותה. כך גם בנוגע לדברים שהוחלפו בין הצדדים במהלך הדיון ולהצעה לסיום הסכסוך שהציע.

4.בית המשפט דחה את בקשת הפסלות וקבע שהמערערים לא הצביעו על בסיס כלשהו לחשש אובייקטיבי למשוא פנים. בית המשפט קבע כי מפסיקת בית המשפט העליון עולה במפורש שאין כל מקום לטענת המערערים לפיה העובדה שהשופטת מכירה את התיק ואת הסוגיה העומדת לדיון, מחייבת את פסילתה. בית המשפט הוסיף כי אין גם מקום לטענה כי התייחסותו לפרשנות ולניסוח ההחלטה תפגע במראית פני הצדק. נקבע כי ככל שיש צורך בפרשנות כלשהי להחלטה זו, ייעשה הדבר על יסוד הבקשות הרלוונטיות שנדונו במהלך אותו דיון והיו בסיס למתן ההחלטה שניתנה בהסכמת הצדדים. כאמור, הבקשה נדחתה ומכאן הערעור שלפניי.

5.המערערים טוענים כי עצם המחלוקת ביחס לניסוח ולפרשנות ההחלטה מחייבת להורות ששופט אחר יכריע במחלוקת. לטענתם, אף אם בית המשפט יכריע באופן אובייקטיבי, ברור שההחלטה תיראה על ידי מי מהצדדים כמי שניתנה בחוסר אובייקטיביות, המושפעת מכך שבית המשפט הוא שניסח את ההחלטה. לדבריהם, החשש שיִקשה על בית המשפט לבחון באובייקטיביות את ההחלטה שנתן בעבר הוא חשש ממשי. לדעת המערערים, יהיה צורך להידרש לדברים שנאמרו בדיון מיום 24.8.2010, לרבות הצעת בית המשפט שהוצעה מחוץ לפרוטוקול. אף יהיה צורך, לדעתם, בשמיעת עדים שנכחו בדיון. לטענת המערערים, מדובר בעניין נקודתי וכדי להכריע בו אין צורך בשופט המכיר את ההליכים הקודמים. המערערים טוענים עוד כי הם זכאים להליך הוגן שאינו אפשרי שכן יתכן שההכרעה תושפע מזיכרון מעורפל של בית המשפט בנוגע לדיון מיום 24.8.2010. לדברי המערערים, גם הפגיעה במראית פני הצדק מצדיקה את קבלת הערעור והעברתו לידי מותב אחר.

6.דין הערעור להידחות. פסילת שופט הדן בתיק למעלה מ-10 שנים בשל כך שפרשנות החלטה שנתן בעבר שנויה במחלוקת אינה מקימה עילת פסלות. כבר נכתב בעבר כי אין בעובדה שאותו שופט דן בהליכים קודמים הנוגעים לאותה פרשה עובדתית ומהווים המשך ישיר שלה כדי לשמש עילה לפסילת השופט (למשל, ע"א 7137/12 עוקב נ' רשות המיסים - אגף המכס והמע"מ (3.3.2013). אף הבעת עמדה או דעה על ידי שופט במסגרת הליך קודם אינה מקימה, בדרך כלל, חשש ממשי למשוא פנים (למשל, ע"א 6172/11 כהן נ' אמויאל (18.9.2011)). בוודאי נכונים הדברים כשמ דובר באותו תיק ממש ((יגאל מרזל דיני פסלות שופט 266-265 (2006)). זאת ועוד, פסילת שופט מלשבת בדין אינה מעשה של מה בכך, ולכן אין די בעובדה שעל בית המשפט להכריע בעניין בו דן בעבר או בנגזרותיו, או הביע עמדה, כדי לגרום לפסילתו. על מנת להצליח בבקשת פסלות יש להוסיף ולהראות כי מאותה החלטה מוקדמת, או מנסיבות אחרות, עולה חשש ממשי למשוא פנים. אין זה המקרה דנא. המערערים לא הצביעו על בסיס כלשהו לחשש אובייקטיבי למשוא פנים כלפיהם מצד בית המשפט. בנסיבות אלו קם חשש כי בקשת הפסלות והערעור דנא הוגשו כדי לנסות לערער בדרך עקיפה על החלטות השופטת היושבת בדין. לכך אין לתת יד.

הערעור נדחה. משלא הוגשה תשובה אין צו להוצאות.
