המשנה לנשיאה א' ריבלין:

המערער משיג על החלטת בית המשפט המחוזי בנצרת (כבוד השופטת ז' הווארי) למחוק על הסף את התובענה שהגיש נגד המשיבות. מ דובר בתובענה שהוגשה בדרך של המרצת פתיחה, ואשר בה ביקש המערער כי בית המשפט יצהיר על כך שהמשיבה 1 התחייבה בהסכם להעביר לבעלותו מגרשים בכפר שיבלי. בית המשפט התבקש גם להורות על העברת המגרשים לשמו של המערער.

בית המשפט המחוזי היה ער בהחלטתו לזהירות הרבה שיש לנקוט בה בטרם מחיקת תביעה על הסף בשל היעדר עילה, ולכללים הנהוגים בעניין זה. עם זאת, לאחר שבחן בדקדקנות את המסמכים שהמערער ביקש לסמוך עליהם את גרסתו, ונדרש לכל טענותיו של המערער, לא מצא בית המשפט כל סיכוי שאלה יוכלו להקנות למערער את הסעדים שביקש. בית המשפט סיכם כי "טענותיו של המשיב [המערער כאן] בעניין הזכויות במקרקעין נדונו ונבחנו לעומקם בבתי המשפט השלום והמחוזי והוכרעו. ואף אם יוכחו כל הטענות אותן מעלה המשיב [המערער כאן] בהמרצת הפתיחה, לא יהיה זכאי לסעד המבוקש". התובענה נמחקה אפוא על הסף בהתאם להוראת תקנה 100(1) לתקנות סדר הדין האזרחי, התשמ"ד-1984.

לא מצאנו עילה להתערב בפסק-הדין. עיון בטענות המערער ובמסמכים המצורפים מעלה כי כפי שקבע בית המשפט המחוזי, אין כל סיכוי שהטענות והמסמכים הללו יובילו למתן הסעדים שנתבקשו בהמרצת הפתיחה. המערער לא הצביע, ולוּ בקירוב או בדוחק, על התגבשות הסכם מחייב המעניק לו את הזכויות שהוא טוען להן.

אשר על כן, הערעור נדחה. בכך אין כדי למנוע ניסיון להגיע להסדר עם המערער, ברוח דין ודברים שהתקיים בעבר. המערער יישא בשכר טרחת עורך-הדין של המשיבות בסכום של 15,000 ש"ח.
