פסק-דין

1.ערעור על החלטת בית משפט השלום בירושלים (כבוד השופטת ד' פיינשטיין), מיום 23.4.2014, בת.א. 10837-07, לפיה נדחתה בקשת המערערים כי בית המשפט יפסול עצמו מלהמשיך לדון בהליך המתנהל בעניינם.

2.בבית משפט השלום מתנהלות תביעה ותביעה שכנגד שהגישו בעלי הדין. התביעות שהוגשו בשנת 2007, נדונו לפני מספר שופטים עד שהועברו לטיפולה של השופטת. הבסיס לתביעות הוא הסכם שנחתם בין בעלי הדין בנוגע לביצוע עסקה משולבת לרכישת נכס ולבניית מבנה שישמש את המערערים כנגרייה. מאחר שהבנייה לא התקדמה כמוסכם, הוצע למערערים מבנה חלופי לשימוש כנגרייה עד להשלמת הבנייה, ואולם הבנייה לא הסתיימה והמערערים עברו למבנה שטרם הושלם. בעקבות האמור, נתגלעו מחלוקות בין בעלי הדין אשר הביאו, כאמור, להגשת תביעה על ידי המשיבים ותביעה שכנגד על ידי המערערים.

3.ביום 28.5.2013 קיים בית המשפט ישיבת הוכחות בה נשמעו מרבית העדים מטעם בעלי הדין. או אז הציע בית המשפט בנוכחות באי-כוח בעלי הדין בלבד לשקול פשרה, בשים לב לסיכויים ולסיכונים של התביעה והתביעה שכנגד. בא-כוח המערערים התפרץ והתרעם מאוד נוכח הצעת הפשרה, והודיע שיאלץ לבקש את פסילת בית המשפט. נוכח דברים אלה סיים בית המשפט את הדיון. יומיים לאחר מכן הגישו המערערים בקשה לפסול את בית המשפט מלהמשיך לדון בעניינם. במסגרת הבקשה טענו המערערים כי בית המשפט הציע את הצעת הפשרה לבאי-כוח בעלי הדין עוד בטרם נשמעו כל עדיהם. עוד טענו המערערים כי בית המשפט פתח ואמר: "איזו חוצפה יש ללקוחות שלך להמשיך ולהחזיק במבנה (של התובעת [המשיבה]) עד שנת 2004 כשבניית המבנה (שהיה מיועד למשיבה 1) הסתיימה בסוף 2001. גם לפי חוות דעת המומחה יגאל ברמן, עלות השלמת הבניה לא עולה על כ-40,000$ ואת הסכום הזה ניתן לקזז. זה יהיה בסופו של דבר מה שאני אפסוק". על יסוד דברים אלו טענו המערערים כי דעתו של בית המשפט ננעלה באשר לתוצאות ההליך ולכן ביקשו את פסילתו. המשיבים הגיבו לבקשה ואף הוגשה תשובה של המערערים.

4.בית המשפט דחה את בקשת הפסלות וקבע כי דעתו לא ננעלה. בית המשפט ציין כי הוא מציע לשקול פשרה, כדבר שבשגרה, כאשר הוא סבור שיש פנים לכאן ולכאן, ובמיוחד כשלבעלי הדין יש אינטרסים החורגים מגבולות הסכסוך הנדון לפניו. בית המשפט הבהיר כי רק החל בהצגת פן אחד של תביעת המערערים, וציין כי הם לא הקטינו את נזקיהם והמשיכו להחזיק בנכס החלופי של המשיבים, אף לאחר שקיבלו חוות דעת שמאית שאמדה את היקף ההוצאות המשוער. בית המשפט הוסיף כי אכן ציין שיתחשב בשאלת הקטנת הנזק כשישקול את הפיצוי המגיע למערערים, אך דחה את טענת המערערים בבקשת הפסלות שלפיה אמר "כך בסופו של דבר אפסוק". בית המשפט הבהיר כי קיימות שאלות נוספות בהן טרם גובשה דעתו, הקשורות לנזקי המערערים, והוסיף כי לא הספיק לשוחח עם באי-כוח בעלי הדין על סיכונים וסיכויים של עילות תביעה נוספות ושל עילות התביעה של הצד שכנד, שכן בא-כוח המערערים התפרץ על בית המשפט בקול והתרעם מאוד נוכח הצעת הפשרה שהציע בית המשפט. אז קטע בית המשפט את חילופי הדברים שהיו מחוץ לפרוטוקול וסיים את הדיון. בעקבות החלטה זו הוגש הערעור שלפניי.

5.המערערים מציינים כי בקשת הפסלות הוגשה ביום 30.5.2013. לדבריהם, תמוה שלקח לבית המשפט כמעט שנה לגבש את החלטתו בבקשה, וזאת בניגוד לאמור בסעיף 77א(ב) לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984 (להלן - החוק), ומבלי להסביר את פשר העיכוב במתן ההחלטה. המערערים תוהים האם לאחר זמן כה רב זכר בית המשפט טוב מהם מה נאמר על-ידו. באי-כוח המערערים עומדים על טענתם בדבר אמיתות ודיוק הציטוט שלעיל. המערערים מוסיפים כי חילופי הדברים עם באי-כוח בעלי הדין בתום הדיון הייתה קצרה ביותר. לטענתם, בית המשפט לא אמר שיתחשב בשאלה של הקטנת הנזק, אלא התבטא כפי שציינו, ואכן, בא-כוחם התרעם על הדברים ועל הסגנון והודיע שיבקש לפסול את בית המשפט. על יסוד האמור טוענים המערערים כי לא ניתן עוד לקיים משפט הוגן לפני בית המשפט ולכן מבקשים לקבל את הערעור.

6.בטרם אדון בערעור לגופו אעיר כי אכן על פי סעיף 77א(ב) לחוק חייב שופט להחליט בבקשה לפסילתו "לאלתר ולפני שייתן כל החלטה אחרת". ואולם, בית המשפט איננו מחויב לקבל החלטה בבקשת הפסלות ביום בו הוגשה. בפסיקה פורשה הוראת סעיף 77א(ב) לחוק כמחייבת הכרעה בבקשת הפסלות בטרם ימשיך בית המשפט לעסוק בהיבטים אחרים של ההליך (למשל, ע"פ 2749/14 גאון נ' מדינת ישראל (18.4.2014)). התכלית העומדת בבסיס סעיף 77א(ב) לחוק ברורה: מאחר שטענת פסלות יורדת לשורשו של ההליך, שכן היא מטילה ספק בכשירותו או יכולתו של השופט לשבת בדין בתיק המסוים, ברי כי כל החלטה שאינה קשורה לשאלת הפסלות תועמד בצל טענת הפסלות, אם זו לא תוכרע תחילה. אף יש היגיון בהתמודדות עם טענות בדבר התבטאויות שנאמרו לכאורה על ידי בית המשפט במהלך הדיון בסמוך למועד אמירתם (השוו: ע"א 2641/13 סופר נ' איתן ארז, עו"ד (6.5.2013); יגאל מרזל דיני פסלות שופט 319-317 (2006)). לפיכך, צודקים המערערים בטענתם לפיה בית המשפט התמהמה במתן החלטתו בבקשת הפסלות שהגישו. חרף האמור, דין הערעור להידחות לגופו.

7.העובדה שבית המשפט ניסה להביא את הצדדים לידי פשרה, כשלעצמה, אין בה כדי להקים עילת פסלות. כבר נפסק בעבר כי עצם העובדה שבית המשפט ניסה להביא להסכמה כדי לסיים את ההליך, אינה מצביעה על גיבוש דעה מוגמרת באותו עניין, גם כאשר ההצעה מועלית בשלב ההוכחות (למשל, ע"א 1422/14 סרור נ' עיריית רמת גן (24.3.2014); יגאל מרזל, בעמ' 180-178). בסמכותו הטבועה של בית המשפט לנהל את הדיון ולהציע הצעות, לרבות הצעות פשרה לסיום המחלוקת שלפניו, מתוך רצון לחסוך במשאבים של בעלי הדין ובזמנו של בית המשפט. לכן, אין בעצם העלאת ההצעה כדי לבסס חשש ממשי למשוא פנים המקים עילת פסלות.

8.במקרה דנא הבהיר בית המשפט בהחלטתו הדוחה את בקשת הפסלות כי לא הספיק להציע את כל הצעתו לפשרה ולא הציג את כל השיקולים, הסיכונים והסיכויים של בעלי הדין, וזאת בשל התנהלותו של בא-כוח המערערים. בית המשפט הכחיש כי אמר את המלים המיוחסות לו בעניין מה שיפסוק. יוער, כי בית המשפט ציין בהחלטתו כי סמך על תרשומת שערך מיד לאחר הדיון, שכן תגובתו של פרקליט המערערים "הייתה חריגה ביותר". אפילו אניח כי בית המשפט התבטא בצורה לא מוצלחת בהעלאת הצעתו לפשרה, הרי שאין בהתבטאות מעין זו, שנאמרה, לפי בית המשפט, משום עילת פסלות (למשל, ע"א 8182/13 בן-עזרא נ' מבנה עופרים בע"מ (19.1.2014)). בנסיבות העניין, נחה דעתי כי בית המשפט לא גיבש עמדה סופית ונחרצת בתביעה ובתביעה שכנגד וכי דעתו לא ננעלה. משכך, דין הערעור להידחות.

הערעור נדחה. משלא הוגשה תשובה אין צו להוצאות.
