החלטה
בשלב זה קיבלו הצדדים את המלצת בית המשפט, לפיה יוכרעו הערעורים על דרך הפשרה לפי סעיף 79א לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, לפי המתווה הבא:
1.באשר למערערים בע"א 3299/07 – יעלו הצדדים טיעונים באשר לפיצוי אשר ינוע בטווח שבין 80,000 ל-140,000 ש"ח בערכי יום מתן פסק הדין בבית משפט קמא.
2.באשר למערערים בע"א 3341/07 – ינוע הפיצוי שייפסק בטווח שבין 40,000 ל-80,000 ש"ח בערכי יום מתן פסק הדין בבית משפט קמא.
כמו כן, יופחת סכום ההוצאות שפסק בית משפט קמא במסגרת ההכרעה על דרך הפשרה, כאמור.
החיובים יהיו: בע"א 3299/07 – לגבי מערערים 1 ו-2 ביחד ולחוד, לגבי מערערים 3 ו-4 ביחד ולחוד, באשר למערער 5 לחוד; ובאשר למערערים בע"א 3341/07 ביחד ולחוד.
למען הסר ספק, לגבי הנתבעים אשר אינם צד לערעורים שבפנינו יעמוד בעינו פסק דינו של בית משפט קמא.
כמו כן, מובהר, למען הסר ספק, כי סכומים ששילם חנן סופר במסגרת השתייכות לקבוצת "אמיגו-טויס" יזקפו לטובת "אמיגו טויס" במסגרת ההתחשבנות שתערך בין הצדדים באשר לסכום ההחזר בהנתן פסק הדין על דרך הפשרה, כאמור לעיל.

לאחר ששמענו את הצדדים אנו פוסקים כלהלן:

אנו מחייבים את המערערים לשלם לתובעת הסך של 50,000 (חמישים אלף) ש"ח.

אנו מחייבים את המערערים 2-1, ביחד ולחוד (ש.י.י.צעצועים בע"מ ושי יונה) לשלם לתובעת הסך של 35,000 (שלושים וחמישה אלף) ש"ח.
אנו מחייבים את המערערים 3-4 ביחד ולחוד (בז'ה פלור בע"מ ויניב יונה) לשלם לתובעת הסך של 45,000 (שלושים וחמישה אלף) ש"ח.
אנו מחייבים את המערער 5 (דמארי) לשלם לתובעת הסך של 20,000 (עשרים אלף) ש"ח.
לכל הסכומים דלעיל יש להוסיף שכ"ט עו"ד בסך 15% מהסכום שנפסק בצירוף מע"מ.
הסכומים המפורטים לעיל הינם בערכי יום מתן פסק הדין בבית המשפט המחוזי בת"א 2320/02 ובהתאם לפסק דין זה שניתן על דרך הפשרה, על המשיבים להשיב למערערים סכומים ששולמו על ידם ביתר על פי פסק דינו של
2320/02, כאמור.
אין צו להוצאות בערעורים.
