ערעור על פסק דינו של בית המשפט המחוזי בחיפה בת"א 513/02 שניתן ביום 14.4.2010 ע"י כבוד השופטת ב' טאובר

המערערים הגישו תביעה ל בית המשפט המחוזי בחיפה ובה עתרו לתקן את הרישום בפנקסי המקרקעין כך שיירשמו זכויותיו הנטענות של מורישם-המנוח. התביעה הוגשה 32 שנה לאחר השלמת הליכי הסדר זכויות במקרקעין בעקבות פסק דין שניתן ביום 30.11.1970 בתיק הסדר ירכא/531. לטענת המערערים, פסק הדין ניתן בהיעדר המצאה כדין, היות ובנו הבגיר של המנוח, אשר חתם ואישר את הזימון לדין, לא התגורר באותה עת עם אביו-המנוח באותו בית. מכאן טענת המערערים, כי לא נעשתה המצאה כדין.
בית המשפט דחה את טענת המערערים, ולאחר שמיעת עדותו של בנו של המנוח, קבע כי בוצעה המצאה כדין. מכל מקום, כך הוסיף בית המשפט קמא וקבע, כי אף אם ייאמר שלא היתה המצאה כדין, מתקהה עוקצו של פגם זה ומתגבר משקלם של שיקולים נוגדים כגון עקרון סופיות הדיון. זאת, נוכח חלוף עשרות שנים מאז ניתן פסק הדין ונוכח אפס המעשה מצד המנוח או יורשיו שטענו לזכויות בקרקע בשלב ההסדר, וכן נוכח שינוי הנסיבות. בית המשפט קמא אף הפנה בענין זה לפסק דין שניתן לאחרונה בסוגיה דומה בע"א 1560/07 מינהל מקרקעי ישראל נ' עיזבון המנוח ג'בור מיכאיל עסאף ז"ל (לא פורסם, 20.1.2010), ואשר נכון לנסיבות בענייננו מדרך של קל וחומר.
מעבר לצורך, מצא בית המשפט המחוזי כי בחלוף השנים הועברו המקרקעין, שנרשמו על שם המדינה בעקבות הליכי ההסדר, לקרן קיימת לישראל וזו נרשמה כבעלים בתום לב ובהסתמך על הרישום של המדינה. לכן, דין התביעה להידחות גם בשל הוראת סעיף 10 לחוק המקרקעין, התשכ"ט-1989.
