ערעור על פסק דינו של בית המשפט המחוזי בחיפה בה"פ 305/06 שניתן ביום 18.5.2009 על ידי כבוד השופט י' כהן

הצדדים הגיעו להסכמה לפיה יוכרע הערעור לפי סעיף 79א' לחוק בתי המשפט, התשמ"ד-1984.

לאחר ששמענו את טיעוני הצדדים, אנו מורים כי המערער ישלם למשיב 6 סך של 17,000 דולר על פי השער היציג, וזאת תוך 90 יום מהיום.

רשמנו בפנינו את הסכמתו האדיבה של המשיב 1 לוותר על ההוצאות שנפסקו לזכותו ב בית משפט קמא, ואנו מפחיתים את ההוצאות שנפסקו לזכות המשיבים 2 ו-6, כך שבמקום הסך של 15,000 ₪ בצירוף מע"מ שנפסק לכל אחד מהם, ישולם הסך של 10,000 ₪ בצירוף מע"מ לכל אחד.

בכפוף לתשלום הסכומים הנ"ל, יתוקן הרישום בנוגע לחלקה 60 בגוש 18727, כך שמתוך חלקו של המשיב 1 ייגרע חלק המשקף 282 מ"ר. תיקון זה יבוצע על ידי רשם המקרקעין כך שבסך הכל יהא המערער הבעלים הרשום של 1505 מ"ר, כשטח המשקף את השטח שרכש המערער מהמנוח ח'יר מוחמד עמאר (להלן: המנוח) ביום 9.11.1975.
