משלא הוגשה עמדת המשיבה 3, ובהסכמת המשיבים 2-1, הערעור יימחק לבקשת המערער ללא צו להוצאות. האגרה תושב בניכוי הסכום הקבוע בתקנות והערובה תושב לחשבון הבנק של בא-כוח המערער, כמבוקש, בכפוף לבדיקה עדכנית של המזכירות כי אין מניעה שבדין לכך.
