פרקליטם של המשיבים ביקש כי נגדיל את סכום שכר הטרחה שפסק בית המשפט המחוזי (180,000 ש"ח), וכי נקבע כי על המערערת לשאת בהוצאות (כולל אגרה) בהליך בבית משפט קמא. לא ראינו מקום להתערב בשני עניינים אלה, שכר הטרחה וההוצאות. כמו כן לא ייפסקו הוצאות ושכר טרחה לעניין הערעור והערעור שכנגד.

פסק-דין
1.בפנינו ערעור וערעור שכנגד על פסק-דין של בית המשפט המחוזי מרכז-לוד (כבוד השופט א' יעקב). בית המשפט פסק במחלוקות שונות ובין היתר חויבה המערערת לשלם סכומי כסף שונים למשיבים.
2.במהלך הדיון בפנינו הגיעו בעלי הדין להסכמה, על פי הצעתנו, כי המערערת תשלם למשיבים סכום כסף נוסף על הסכום שכבר שולם למשיבים עם הגשת הערעור ועל סכום אחר שמוחזק בנאמנות על ידי פרקליטיהם של בעלי הדין ושישוחרר לידי המשיבים. כן הוסכם כי בית משפט זה יכריע מהו הסכום הנוסף שעל המערערת לשלמו למשיבים, וזאת על פי סעיף 79א(א) לחוק בתי המשפט, התשמ"ד-1984. בעלי הדין אף הסכימו כי ההכרעה לעניין הסכום הנוסף תהא במנעד שבין 800,000 ש"ח ל-2,000,000 ש"ח, נכון ליום פסק-דיננו. הסכמות נוספות היו אלה:
א) הערת האזהרה שנרשמה לזכות המערערת תימחק.
ב) תיק ההוצאה לפועל שפתחו המשיבים נגד המערערת ייסגר.
3.לאחר ששקלנו את טיעוניהם של בעלי הדין הגענו לכלל מסקנה כי הסכום הנוסף שעל המערערת לשלמו יהא 1,025,000 ש"ח. הסכום ישולם למשיבים תוך 30 ימים מהיום. כמובן שהסכום המופקד ישוחרר לידי המשיבים ויש לעשות כן תוך 15 ימים מהיום. כמו כן תימחק הערת האזהרה שנרשמה לזכות המערערת ותיק ההוצאה לפועל ייסגר תוך 15 ימים מהיום. היה והסכום הנוסף שפסקנו לא ישולם תוך 30 ימים כאמור, הוא יישא הפרשי הצמדה וריבית מהיום והמשיבים יהיו זכאים לפתוח תיק בלשכת ההוצאה לפועל.
4.פרקליטם של המשיבים ביקש כי נגדיל את סכום שכר הטרחה שפסק בית המשפט המחוזי (180,000 ש"ח), וכי נקבע כי על המערערת לשאת בהוצאות (כולל אגרה) בהליך בבית משפט קמא. לא ראינו מקום להתערב בשני עניינים אלה, שכר הטרחה וההוצאות. כמו כן לא ייפסקו הוצאות ושכר טרחה לעניין הערעור והערעור שכנגד.
