ערעור על החלטתו של בית משפט השלום בתל אביב-יפו (כב' השופטת ו' סימון) מיום 9.7.2007, שלא לפסול את עצמו מלדון בת.א. 47078/03.

1.בין הצדדים התנהלה תביעה כספית שהגישה המשיבה כנגד המערער ואחרים. בראשית דיון שהתקיים בתיק ביום 9.7.2007, בו היו אמורים להישמע סיכומי הצדדים בעל פה, ביקש המערער מבית המשפט לפסול את עצמו מלדון בתיק. את הבקשה נימק המערער בשינוי הקיצוני בהצעות הפשרה של בית המשפט לאורך ההליך, ובהערות פוגעות של בית המשפט ביחס למערער, המעידים, לט ענת המערער, על גיבוש עמדה של בית המשפט כנגדו. המשיבה התנגדה לבקשה. בית המשפט, בהחלטה מיום 9.7.2007, דחה את בקשת הפסלות. אשר לשינוי בהצעות הפשרה ציין בית המשפט כי אף פעם דעתו אינה נעולה כאשר הוא מציע הצעות פשרה, והן נגזרות מתמונת המצב העומדת בפניו בכל שלב של ההליך. אשר להערות המיוחסות לבית המשפט, צוין כי לא זכור לבית המשפט שהעיר הערה פוגעת כלשהי. בקשת המערער לעכב את ההליכים עד להכרעה בערעור שיוגש על ההחלטה בעניין הפסלות, נדחתה, והצדדים נדרשו לסכם את טענותיהם. על ההחלטה בבקשת הפסלות הוגש הערעור שבפניי.

2.בהודעה מיום 9.8.2007 ציין המערער כי קיבל הזמנה לשימוע פסק הדין ביום 12.8.2007 בבוקר. לכן, ביקש המערער להכריע באופן דחוף בבקשה להשהיית מתן פסק הדין בעניינו. בקשה זו נדחתה בהחלטה של השופטת ארבל מיום 10.8.2007. מכיוון שכך, ניתן פסק הדין ולמעשה ההליך בפני בית המשפט קמא הסתיים. דיני הפסלות באים לאפשר לבעל דין להשיג על כשירותו הקונקרטית של השופט לדון בעניינו. הבקשה לפסילת השופט במהותה צופה פני עתיד, שכן היא בוחנת את יכולתו של בית המשפט להמשיך ולשבת בדין (ע"א 9614/06 קרפילובסקי נ' ישיבת נזר ישראל מוסדות תורה (לא פורסם, 3.6.2007); ע"א 4602/07 ממשין-חברה להנדסה בע"מ נ' פואד עראם חברה לבנין ופיתוח בע"מ (לא פורסם, 16.7.2007) (להלן: עניין ממשין); יגאל מרזל דיני פסלות שופט 44 (2006)). במקרה הנוכחי סיימה השופטת את מלאכתה בתיק עם מתן פסק הדין ביום 12.8.2007. בנסיבות אלו אין עוד טעם בבחינת המשך יכולתה לשבת בדין, והדיון בשאלת הפסלות הופך להיות במידה רבה מלאכותי באופיו. פסילת השופטת כעת אין מטרתה הפסקת הדיון לפניה, אלא למעשה ביטול פסק דין והליך שכבר הסתיים. ואולם, אף במקום בו קיימת עילת פסלות, לא יהא בהחלטה על פסילתו של שופט במסגרת ערעור פסלות כדי להביא לביטול פסק הדין. זאת, מאחר ודיני הפסלות אינם האכסניה המתאימה לדיון בשאלת תוקפו של פסק דין שניתן שעה שהשופט היה פסול מלשבת בדין. הדרך הראויה לבחון שאלה זו הינה במסגרת ערעור על פסק הדין, אשר במסגרתו תתברר גם ט ענת הפסלות והשלכתה על תוקף פסק הדין (עניין ממשין; מרזל, בעמ' 73-75, 367-368). על כן, דינו של ערעור זה להידחות. המערער יוכל להעלות טענותיו לעניין קיומו של פגם בפסק הדין הנובע מט ענת הפסלות במסגרת ערעור שיגיש, אם יגיש, על פסק הדין. המותב אשר ידון בערעור האזרחי יוכל לבחון, בין היתר, את תוקפו של פסק הדין גם נוכח ט ענת הפסלות (עניין ממשין)).

אשר על כן, הערעור נדחה.
