ערעור על החלטת בית משפט השלום בתל-אביב-יפו (השופט י' אטדגי) בהפ"ב 175230-09 מיום 17.1.2010, שלא לפסול עצמו מלדון בעניינה של המערערת.

1.המערערת הגישה תובענה לביטול פסק בוררות שניתן בין בעלי הדין. פסק הבוררות חייב את המערערת לשלם למשיבה סך של 999,136 ש"ח. לבקשת המשיבה ולאחר קבלת טיעוני הצדדים הורה בית המשפט ביום 23.11.2009, למערערת להפקיד ערובה בסך של 250,000 ש"ח כתנאי לדיון בבקשתה לביטול פסק הבוררות, והמערערת הפקידה את הערובה. עוד בטרם מתן ההחלטה בנוגע לערובה התקיים דיון מקדמי בתובענה במסגרתו הסכימו הצדדים לוותר על חקירות המצהירים ולהגיש סיכומים. לאחר הגשת הסיכומים ממתינה התובענה כעת למתן פסק דין.

2.המערערת הגישה בקשה לפסול את בית המשפט מלהמשיך ולדון בתובענה בטענה כי בהחלטתו בנוגע להפקדת הערובה גיבש בית המשפט את עמדתו הסופית בתובענה באופן היוצר חשש ממשי למשוא פנים. המערערת טענה כנגד דברים שכתב בית המשפט בהחלטה הנוגעת לערובה בקשר לסיכוייה של בקשת הביטול להתקבל. המשיבה התנגדה לבקשה.

3.בית המשפט דחה את הבקשה. בית המשפט קבע כי גם אם שגה בדברים שכתב בהחלטה בנושא הערובה אין זו עילה לפסול עצמו מלדון בתובענה וכי ניתנה למערערת הזדמנות לשכנעו במסגרת הסיכומים. עוד קבע כי פתוחה בפניה הדרך לערער על פסק הדין שיינתן אם תמצא לנכון. בית המשפט קבע כי אין מקום לדון במסגרת בקשת הפסלות בטענות המערערת, שהן למעשה טענות ערעוריות על ההחלטה בעניין הפקדת ערובה. בית המשפט הוסיף כי הדגיש שבחינת סיכויי הבקשה לביטול פסק בוררות הינה לכאורית בלבד ואין בה כדי לקבוע מסקנה סופית לגופה של התובענה. במסגרת בחינה זו נדרש בית המשפט לפירוט ספציפי ולבחינת פרק מרכזי בבקשת המערערת בתמיכתה לבקשת הביטול, לבל תהיה בדיקתו כללית בלבד. עוד הוסיף בית המשפט כי מבחינה מעשית כל שנותר הוא לתת פסק דין בתביעה שעליו, כאמור, תוכל המערערת לערער אם תחפוץ בכך.

4.לטענת המערערת דברי בית המשפט בהחלטה בנושא הערובה נגועים בחוסר מידתיות בניגוד למתבקש בבקשה מעין זו. מאחר ובית המשפט קבע מסמרות בהחלטת הביניים אין ספק, בעיניה, כי גיבש עמדתו ונסתם הגולל על טענותיה בבקשה לביטול פסק הבוררות. המערערת משיגה על התעלמותו של בית המשפט מטענתה המרכזית לפיה הניח בטעות כי בהסכמת הצדדים היה הבורר פטור מדיני הראיות ומן הדין המהותי. לדעתה, מדובר בקביעה נחרצת של בית המשפט הסותמת את הגולל על מרבית מטענותיה. המערערת מסכימה כי על בית המשפט חלה החובה לבחון ספציפית את המקרה שהונח בפניו, אך לדעתה אין היא כוללת בחובה הבעת עמדה נחרצת וקביעות עובדתיות שגויות המלמדות על גיבוש עמדה סופית של בית המשפט. עוד מפנה המערערת לקביעות בית המשפט בהחלטתו בנושא הערובה ומצביעה על טעויות בהן, לטענתה. המערערת מבהירה כי אין מדובר בתחושה סובייקטיבית שלה אלא בחשש ממשי למשוא פנים בניהול המשפט. לפיכך מבקשת היא לפסול כאמור את בית המשפט מלדון בעניינה.

5.דין הערעור להידחות. הלכה פסוקה היא כי אין בנכתב בהחלטת ביניים בתיק כדי ללמד על דעתו של בית המשפט בהמשך הטיפול בתובענה ומיותר לציין כי טענותיה של המערערת, לרבות בנוגע לדינים החלים על הבורר להתברר במסגרת פסק הדין גופו. כאמור, מדובר בענייננו בבקשה להפקדת ערובה וכל שבחן בית המשפט בקשר להחלטה זו הוא את סיכויי התביעה באופן לכאורי נכון למועד מתן ההחלטה ובטרם הוגשו סיכומי המערערת בתיק. אכן, בדיקת בית המשפט את סיכויי התובענה נעשתה באופן פרטני והוא אף נדרש לאחת מטענותיה המרכזיות של המערערת. ואולם, כפי שכתב בית המשפט, בחינת הדברים נעשתה באופן לכאורי בלבד ועדיין נותרה פתוחה הדלת בפני המערערת לשכנע את בית המשפט אחרת, עם קריאת סיכומי הצדדים והתייחסותו לאמור בפסק הבוררות ולכל העילות שהעלתה המערערת בבקשה לביטולו.

6.זאת ועוד. מקריאת הדברים נדמה כי המערערת מנסה בדרך של הגשת ערעור הפסלות להשיג על עצם ההחלטה להפקדת ערובה, ואולם אין זו הדרך. השגות על החלטותיו של בית המשפט מקומן בהליכי ערעור רגילים על פי סדרי הדין, ולא במסגרת הליכי פסלות (ע"א 7186/98 מלול נ' ג'אן (לא פורסם, 3.12.1998); יגאל מרזל דיני פסלות שופט 178-174 (2006)). בנסיבות העניין בהן הפקידה המערערת את הערובה כפי שנדרש ממנה, משנמצא התיק לפני מתן פסק הדין, לא מצאתי כי העובדה שבית המשפט חיווה דעתו על אחת מטענותיה של המערערת, מעידה כי ננעלה דעתו באשר לסיכויי התובענה (ע"א 1800/02 עומרי ם חברה לבניין בע"מ נ' תנופה שירותי כח אדם ואחזקות (1991) בע"מ (לא פורסם, 11.3.2002)), לפיכך דין הערעור להדחות.

הערעור נדחה ללא צו להוצאות.
