בהמשך לישיבה מיום 17.2.2011 ולהסכמת הצדדים לפיה נפסוק על דרך הפשרה לפי סעיף 79א לחוק בתי המשפט [נוסח משולב], התשמ"ד-1984, ולאחר ששמענו את טיעוני הצדדים ועיינו בחומר שהוגש לנו – אנו מחייבים את המערער (עו"ד זילברשלג) לשלם למשיב (פלד) סכום כולל של 110,000 ₪ (מאה ועשרה אלף) נכון ליום מתן פסק דיננו.

הסכום ישולם תוך 14 יום מיום מתן פסק דין זה.

המשיב זכאי לקבל לידיו על חשבון הסכום שנפסק לעיל את סכום הערבות/הפקדון שהופקד על ידי המערער בתיק זה, ויראו פסק דיננו זה כהוראה לגזברות לזכות המשיב וכביצוע התשלום בפועל. היה ולא ישולם הסכום דלעיל במועדו ובשלמותו, יעמוד פסק הדין מושא ע"א 9574/09 בעינו (ת.א. (מחוזי ת"א) 1859/07).

כאמור בהחלטתנו מיום 21.2.2011 שנתנה תוקף להסכמת הצדדים, תשלום הסכום הנ"ל במועדו ובשלמותו מהווה סילוק סופי ומוחלט של כל התביעות ההדדיות של הצדדים במכלול הסכסוכים ביניהם הקשורים במישרין או בעקיפין לשירותי עריכת דין שניתנו על ידי המערער למשיב, לרבות התביעות שהוגשו על ידי המערער כנגד המשיב ב בית משפט השלום בכפר סבא, ויהווה סילוק סופי ומוחלט של כל הסכסוכים בין הצדדים ולא תהיינה למי מביניהם כל טענה או תביעה כלפי משנהו בקשר לשירותי עריכת הדין כאמור לעיל.

ניתן ביום, י"ח באדר א' התשע"א (22.2.2011).
