בקשה מטעם המשיב 1 למחיקת הערעור ובקשה להשלמת טיעון

לבקשת המשיב 1, הוא המערער בהליך העיקרי, ע"א 144/14, ההליך העיקרי נמחק ביום 26.6.2013 (הרשם ג' שני). משעה שההליך העיקרי נמחק, אין משמעות לערעור על החלטת הרשם שלא לצרף את המערער כמשיב להליך, והערעור מתייתר.
טרם חתימה הועברה אליי בקשתו של המשיב 1 להשלים טיעון במעמד צד אחד באשר לבקשה למחיקת הערעור וכן לחייב את המערער בהוצאותיו. לאחר שעיינתי בבקשה ושקלתי אותה, ולנוכח האמור לעיל, הגעתי למסקנה שדינה להידחות.
לפיכך, הערעור נמחק והבקשה נדחית. אין צו להוצאות.
