ערעור על החלטתה של כבוד רשמת בית המשפט העליון ל' בנמלך מיום 27.3.2014 בבש"א 552/14

פסק-דין

ערעור על החלטת הרשמת ל' בנמלך (בש"א 552/14 – א') מיום 27.3.2014 בה דחתה הרשמת את השגת המערערת על החלטת המזכירות שלא לקבל הליך ערעורי שהגישה לרישום.

1.בהחלטה עמדה הרשמת על כך שההליך לא התקבל לרישום משום שלא נראה כי המערערת הייתה בעלת דין בבית המשפט המחוזי, ואין במסמכים שצירפה כדי לבסס את זכאותה להגשת הליך ערעורי. ההשגה נדחתה משני נימוקים. הראשון, כי ההליך הערעורי שהוגש לא הוגש בהתאם לתקנות סדר הדין האזרחי, התשמ"ד-1984; והשני, כי ההשגה לא הבהירה בצורה מספקת מה מעמדה של המערערת בהליך. הרשמת ציינה כי המערערת לא הוכיחה שהיא חליפתו של חמה שהיה מבוטח על ידי אחד הצדדים בהליך עליו הוגש הערעור; וגם אם אכן כך הדבר, לא הוכיחה שמעצם העובדה שהיה מבוטח כאמור, נובעת לו זכות ערעור אישית על פסק הדין.

2.המערערת הגישה ביום 13.5.2014 בקשה להארכת מועד להגשת ערעור על ההחלטה האמורה. בהחלטה נכתב "נבקש מביהמ"ש העליון לאפשרי לי לערער (למרות שעברו 20 יום ממועד ההחלטה שלא קיבלתי בדואר)". הרשם ג' שני קבע בהחלטה (בש"א 3414/14 – א') שאין מהנתונים שלפניו כדי ללמד מתי התקבלה ההחלטה אצל המערערת, אך ציין שביום 1.5.2014 כבר הגישה המערערת בקשה לעיון חוזר בהחלטה. הרשם קבע כי אין מקום לאשר הארכת מועד כמבוקש, אך ציין שככל שלא עבר המועד הקבוע בתקנות להגשת הערעור, אין מניעה להגישו.

3.מכאן הערעור שלפניי, שהוגש ביום 20.5.2014. בערעורה טוענת המערערת כי המשיבה שדדה את המבוטחים (ביניהם, לטענתה, חמה) והיא מוחה על סגירת התיק ללא פשרה. עוד טענה כי בעלה הוא בנו היחיד של חמה, והיא צירפה טופס חליפות המעיד על כך שהוא חליפו.

4.לא שוכנעתי שהערעור אכן הוגש במועד הקבוע בתקנות. היה ראוי כי המערערת תצביע בערעור שהגישה על המועד בו הומצאה לה ההחלטה מושא הערעור. אך גם לגופו של עניין דינו של הערעור להידחות. אף אם המערערת הוכיחה יחסי חליפות בין בעלה לאביו (ולטעמי, ספק אם הדבר הוכח), הרי שהיא לא הוכיחה כי האב, חמה, היה בעל זכות ערעור בהליך בבית המשפט המחוזי. די בכך כדי לדחות את הערעור, וזאת מבלי להתייחס לצורת הגשתו, שכאמור בהחלטת הרשמת, די היה בכך כדי לדחות את הערעור.

5.סוף דבר, הערעור נדחה.
