פסק-דין
1.כבוד הרשם (י' מרזל) דחה את בקשת המערער למתן פטור מלא מהפקדת ערבון בגדר בקשת רשות ערעור והעמיד את סכום הערבון על סך 5,000 ש"ח. נגד החלטה זו מופנה הערעור שבפניי.
2.בחנתי את טענות הצדדים ונחה דעתי כי דין הערעור להידחות. בקשת רשות הערעור מופנית נגד החלטה מיום 10.2.09 של בית המשפט המחוזי. הבקשה כוללת שני ראשים: האחד, טענות המערער בנוגע לאופן הטיפול בתביעת חוב שהגיש; השני, דרישת המערער להעביר את המשיב 1 (להלן - המשיב) מתפקידו ככונס נכסים. באשר לראש הראשון, מסתבר כי ביום 15.3.09 דחה המשיב את תביעת החוב שהגיש המערער. הדרך להשיג על החלטה זו היא הגשת ערעור לבית המשפט המחוזי. בגדר הערעור רשאי המערער להעלות את השגותיו בכל הנוגע לטיפול בתביעת החוב שלו. מכאן, שבקשת רשות הערעור בכל הנוגע לראש זה התייתרה. באשר לראש השני, לא שוכנעתי כי לתביעה לפטר את המשיב יש סיכוי של ממש. המסקנה המתבקשת מניתוח זה היא כי סיכויי הבקשה לרשות ערעור, על שני ראשיה, קלושים. משכך, אף אם אניח כי הוכחה דלות כלכלית אין מקום לפטור את המערער לחלוטין מהפקדת ערבון.
3.הערעור נדחה. הערבון יופקד תוך 15 ימים מיום המצאת פסק דין זה, שאם לא כן יידחה ההליך בלא התראה נוספת. המערער יישא בשכר טרחת עורך דין בסך 1,000 ש"ח לזכות כל אחד מן המשיבים.
