1.לפניי ערעור ובקשה לעיכוב ביצוע על החלטת הרשם ג' שני, במסגרתה דחה את בקשת המערערת לפטור מהפקדת עירבון, במסגרת הליך רע"א 8186/13 מיום 29.12.2013. בהחלטתו, קבע הרשם כי לא הוצגה התמונה המלאה באשר למצבה הכלכלי של המערערת. כמו כן, ציין הרשם כי המערערת מיוצגת בהליך העיקרי ושילמה את האגרה בעבורו. לעניין סיכויי ההליך הוסיף הרשם כי מדובר בהליך ב"גלגול שלישי".

2.מכאן הערעור שלפניי, במסגרתו טוענת המערערת כי המסמכים שצורפו לבקשת הפטור מעירבון היו מספקים להוכחות היעדר מסוגלות כלכלית, מוסיפה להם הסברים ומצרפת מסמכים נוספים. עוד טוענת המערערת וטוענת כי סיכויי ההליך העיקרי טובים הם. לבסוף, מוסיפה המערערת כי שכר טרחתו של בא-כוחה ייגבה רק בסיום ההליך, מתוך הסכום שייפסק לטובתה.

3.דין הערעור להידחות. לא מצאתי פגם המצדיק התערבות בהחלטת הרשם. כידוע, שיקול דעתו של הרשם רחב, ולא בנקל תתערב בו ערכאת הערעור (ראו: בשג"ץ 8760/12 ואן קול נ' גנות (5.5.2013); בש"א 5814/12 ליברוב נ' בית חולים אלישע (14.8.2012)). במסגרת בקשה לפטור מהפקדת עירבון, על המבקש הנטל להוכיח שני תנאים מצטברים: היעדר מסוגלות כלכלית וסיכויי ההצלחה בערעור (ראו: בש"א 1528/06 ורנר נ' כונס הנכסים הרשמי, פסקה 7 (17.10.2007)).

4.במקרה דנן, השתכנעתי כי אין די במסמכים שהוגשו על ידי המערערת כדי להוכיח היעדר מסוגלות כלכלית. כידוע, בעל דין נדרש להוכיח במסגרת בקשה לפטור מהפקדת עירבון כי אין ביכולתו לגייס כספים מחבריו וקרוביו לטובת הפקדת העירבון שנקבע (ראו: בש"א 6411/11 שני נ' עו"ד ארז חבר, נאמן לנכסי החייב (3.10.2011)). במקרה דנן, המערערת לא הציגה שום הוכחה לעניין זה. יתר על כן, מטענותיה בערעור ניתן ללמוד כי נעזרה כספית בחבריה במקרים אחרים. לצד עניין זה, יש לציין כי למערערת תוכנית חסכון ופיקדונות קבועים (לעניין זה ראו: החלטת הרשם י' מרזל בע"א 4591/07 סוויד נ' רושרוש (6.8.2007); החלטת הרשם ג' שני בעע"ם 2109/12 זאהי נ' הוועדה המחוזית לתכנון ובנייה מחוז חיפה (22.4.2012)). במצב עניינים מעין זה, החלטתו של הרשם לדחות את הבקשה, מאזנת נכונה בין השיקולים השונים.

5.סוף דבר, הערעור נדחה. ממילא מתייתר הצורך לדון בבקשה לעיכוב ביצוע. המערערת תשלם את העירבון, עד ליום 19.1.2014. לא תעשה כן, יירשם ההליך לדחייה ללא כל הודעה נוספת. בנסיבות העניין, אין צו להוצאות.
