1.העותר התגייס לצבא דרום לבנון ביום 1.1.1991. ביום 23.5.2000, ועם יציאת צה"ל מדרום לבנון, יצא גם העותר את גבולות המדינה והגיע למדינת ישראל עם הוריו, שתי אחיותיו ואחיו. בחודש אפריל 2000, לקראת יציאתו של צה"ל מדרום לבנון, הוכר העותר כזכאי לשיקום וטיפול של המינהלה הביטחונית לסיוע (להלן: מנב"ס) בגין שירותו בצד"ל ועמידתו בכללים שנקבעו לעניין זה. במסגרת שיקומו קיבל העותר ממנב"ס סיוע כספי בסך 45,271 ₪ וכן סיוע בהסדרת מעמדו בישראל.

2.במהלך שנת 2000 ולאחר הגעתו למדינת ישראל נעצר העותר בגין עבירות ייבוא וסחר בסמים. ביום 29.4.2001 הורשע העותר בבית המשפט המחוזי בנצרת, בהתאם להודאתו במסגרת הסדר טיעון, בעבירות של ייבוא וסחר בסם מסוכן, אחזקת סם שלא לשימוש עצמי וקשירת קשר לביצוע פשע ונגזרו עליו שנתיים מאסר בפועל ושלוש שנות מאסר על תנאי למשך שלוש שנים. כמו כן הוטל עליו קנס של 5,000 ₪ או 50 ימי מאסר תמורתם (ת.פ. 1194/00).

3.על רקע הרשעתו זו ובהתאם למדיניות מנב"ס הוחלט להפסיק את הטיפול השיקומי בעותר. ביום 26.12.2001 הודיע נציג מנב"ס לעותר על הכוונה להפסיק את הטיפול בעניינו. באוגוסט 2002 אושרה החלטה זו על ידי ראש השב"כ וביום 26.8.2002 נערכה פגישה עם העותר במהלכה נודע לו באופן רשמי על סיום טיפולו השיקומי על ידי מנב"ס.

4.העותר הגיש את העתירה דנן ביום 4.12.2007 וטען במסגרתה כי הוא מופלה לרעה ביחס ליתר אנשי צד"ל. לטענתו, יש להעניק לו מענק הוקרה חד פעמי ומענק נוסף בשיעור 40,000 ₪ המשולמים לאנשי צד"ל מכוח סעיף 8 לחוק אנשי צבא דרום לבנון ומשפחותיהם, התשס"ה-2004 (להלן: החוק). העותר טוען כי הוא שילם את המחיר על העבירות בגינן הורשע וריצה את עונשו ואין כל מקום להמשיך ולהעניש אותו בעונש נוסף ולשלול "זכויות שמגיעות לו על פי דין". לטענת העותר יש להחזירו לטיפול שיקומי במסגרת מנב"ס, או לחילופין להעניק לו את ההטבות אשר הוענקו בעבר לאנשי צד"ל שלא טופלו במסגרת מנב"ס, אלא היו תחת טיפולו של המשרד לקליטת העלייה.

5.מתשובתה של המשיבה, אשר הוגשה ביום 16.7.2008, עלה כי יומיים קודם לכן, ביום 14.7.2008, נשלח לבאת כוח המשיבה, עורכת הדין ליאורה וייס-בנסקי, מכתב עליו חתום סגן היועץ המשפטי למערכת הביטחון וממנו עולה כי שר הביטחון החליט לשלול מהעותר רבע ממענק ההוקרה הנוסף לו זכאים אנשי צד"ל (בסך של 10,000 ₪). יחד עם זאת החליט השר כי העותר יקבל את יתרת המענק הנוסף (בסך של 30,000 ₪) וכן את מלוא המענקים בגין עבודתו בעבר המבוססים על השכר שקיבל בלבנון (בסך של 89,856 ₪).

המשיבה טענה בתשובתה כי נוכח החלטה זו, לפיה מוענק לעותר רוב רובו של סכום המענק, יש לדחות את העתירה. כמו כן טענה המשיבה כי אין מקום להיענות לבקשתו של העותר ולהעניק לו את סל המענקים שהוענק לאנשי צד"ל על ידי המשרד לקליטת העלייה בין היתר נוכח העובדה שהעותר הוכר מלכתחילה כזכאי לשיקום על ידי מנב"ס וקיבל במסגרת זו הטבות נרחבות. לדבריה אין זה סביר לאפשר לאדם שהורשע בעבירות חמורות לעבור למסלול חלופי שלא יועד לו מלכתחילה. בנוסף טענה המשיבה כי אין כל מקום להיענות לבקשתו של העותר לפיה הוא יוחזר לטיפול שיקומי במסגרת מנב"ס שכן לעותר אין זכות שבדין לקבל סיוע ממנב"ס, שהינו סיוע המוענק לפנים משורת הדין. לטענת המדינה העותר ניצל לרעה את המעמד אשר ניתן לו בישראל ועסק בייבוא ובסחר בסמים ומשכך זכאית המשיבה שלא להעניק לו "סעד של חסד" הניתן לפנים משורת הדין.

6.בתגובתו מיום 23.7.2008 לדברים אלו וכן בדיון שנערך לפנינו עמד העותר על עתירתו ושב וטען כי הוא "יצא קירח מכאן ומכאן". לדבריו אין מקום לשלול ממנו גם את ההטבות המוענקות לאנשי צד"ל במסגרת הטיפול על ידי מנב"ס וגם את ההטבות שהיו יכולות להגיע לו מהמשרד לקליטת העלייה. לדבריו הוא זכאי, לכל הפחות, למלוא ההטבות שהוענקו לאנשי צד"ל על ידי המשרד לקליטת העלייה.

דיון והכרעה

7.דין העתירה להידחות.

8.ביום 16.9.2001 התקבלה החלטת ממשלה מספר 720, שעניינה קליטת אנשי צד"ל ואנשי מנגנוני הביטחון הלבנוניים בישראל. על פי ההחלטה, האחריות הכוללת לאנשי צד"ל הועברה למשרד לקליטת העלייה, אולם יחד עם זאת נקבע כי מנב"ס תוסיף לטפל באוכלוסייה מיוחדת שעמדה בקשרים מיוחדים עם זרועות הביטחון, ובכלל זה אנשי צד"ל בכירים [ראו: בג"ץ 10513/05 בוטרוס סעיד נ' ממשלת ישראל (לא פורסם, 28.1.2009) (להלן: עניין בוטרוס)]. אין כל ויכוח כי העותר הוכר מלכתחילה כמי שזכאי לשיקום וטיפול של מנב"ס, לאחר שעמד בכללים שנקבעו לעניין זה. במסגרת שיקום זה קיבל העותר סכומי כסף בין היתר בעבור דמי שכירות ולצורך רכישת ריהוט.

9.יחד עם זאת, בעקבות הרשעתו של העותר בעבירות חמורות של ייבוא וסחר בסמים הוחלט על הפסקת שיקומו במסגרת המנב"ס. איננו מוצאים מקום להתערב בהחלטה זו. עת ביצע העותר את העבירות בגינן הורשע הפר הוא את "האמנה החברתית" בינו לבין מדינת ישראל [ראו: פסקה 9 לפסק דינו של המשנה לנשיא (כתוארו אז) מ' חשין בבג"ץ 6427/02 התנועה לאיכות השלטון נ' הכנסת (לא פורסם, 11.5.2006)]. יתרה מכך, למרות הרשעתו בעבירות המהוות פשע חמור החליט שר הביטחון להעניק לו את רוב סכום המענק לו הוא זכאי מכוח סעיף 8 לחוק. מדובר בסכומי כסף נכבדים ששולמו לעותר ושאיפשרו לו להתחיל ולבנות את חייו במדינת ישראל. עובדה זו מהווה סיבה נוספת לדחיית העתירה.

10.לסיום, בקשתו של העותר להעבירו לטיפול המשרד לקליטת העלייה אינה בקשה אקטואלית עוד. נכון להיום לא קיים עוד סל מענקים המוענק לאנשי צד"ל על ידי המשרד לקליטת העלייה והמִנהלת שטיפלה בעניין זה במשרד הנ"ל נסגרה לפני כשנתיים. יתרה מכך, מקובלת עלינו עמדת המשיבה לפיה אין המדובר במסלול חלופי הפתוח לאנשי צד"ל אשר עברו עבירות חמורות ואינם זכאים עוד לסיוע המנב"ס. ההיפך הוא הנכון – הטיפול על ידי המשרד לקליטת העלייה היווה את המסלול החלופי לאותם אנשי צד"ל אשר לא היו זכאים להיכלל תחת טיפולה של המנב"ס [ראו: עניין בוטרוס לעיל וכן בג"ץ 1863/09 נאסיף נ' משרד הביטחון (לא פורסם, 6.7.2009)].

11.אשר על כן, דין העתירה להידחות. בנסיבות העניין אין צו להוצאות.
