המשנה לנשיאה א' ריבלין:

1.העותרת – פורום משפטי למען ארץ ישראל – משיגה על החלטת ממשלת ישראל (החלטה מספר 4285 מיום 30.11.2008) להמליץ לגורמים המוסמכים על שחרורם של כ- 250 אסירים פלסטינים "לרגל חג הקורבן וכמחווה של רצון טוב לראש הרשות הפלסטינית" (כך לשון ההחלטה). לדעת העותרת אין הממשלה – ממשלת מעבר – רשאית להחליט כך. זאת לאור הצרת מתחם הפעילות של ממשלת מעבר, ולאור היעדר אחריות של ממשלה כזו אם בעתיד יתממש הסיכון הטמון במהלך. עוד טוענת העותרת כי הממשלה לא ביצעה עבודות מטה כנדרש עובר לקבלת ההחלטה, ולא הפיקה לקחי עבר. לדעת העותרת, שחרור אסירים בעבר לא הוביל לכל תוצאה חיובית אלא אך ורק למעשי טרור. העותרת סבורה כי אין כל דחיפות במהלך הנדון, ואין זה מהלך חיוני, ועל כן מוטב שלא לקבלו בעת מעבר.

יצוין כי ועדת השרים שהתכנסה ביום 7.12.2008 קבעה רשימה של אסירים מומלצים המונה 230 אסירים. המדינה מבהירה כי לא נכללים ברשימה אסירים עם "דם על הידיים".

2.בחנו את טענות הצדדים והחלטנו לדחות את העתירה.

הכללים החלים על פעילותה של ממשלת המעבר הותוו ב בג"ץ 5167/00 וייס נ' ראש הממשלה של מדינת ישראל, פ"ד נה (2) 455 (2001) (להלן: פרשת וייס), שם נדונה שאלת ניהול משא ומתן מדיני על ידי ממשלת מעבר לאחר התפטרותו של ראש הממשלה. כפי שהובהר באותה פרשה, החוק אינו תוחם את היקף הסמכויות המסור לממשלת מעבר, וזה אינו שונה מהיקף הסמכויות של ממשלה "רגילה". עם זאת, הודגש שם כי "מיתחם הסבירות של ראש ממשלה שהתפטר ושל חברי ממשלתו צר ממיתחם הסבירות של ראש ממשלה ושל ממשלה המכהנים כרגיל. הטעם לכך הוא זה שעל ראש ממשלה זה ועל ממשלה יוצאת זו לקחת בחשבון את הנתון המיוחד - נתון שממשלה ברגיל אינה צריכה להתחשב בו - והם תכלית קיומה ומקור סמכותה. זאת ועוד: "מיתחם" הסבירות של ראש ממשלה וממשלה אלו משתנה ככל שמועד סיום כהונתו של ראש הממשלה הנבחר מתקרב והולך. על כן,"מיתחם" זה נעשה צר יותר - והצורך באיפוק ובריסון נדרש יותר - לאחר הבחירות, ובטרם יחל ראש הממשלה הנבחר בכהונתו, והכל כפוף לצרכי הציבור החיוניים" (שם, בעמ' 470). בית המשפט, מפי הנשיא א' ברק, ציין כי לאור התכליות העומדות בבסיס כהונתה של ממשלת מעבר – הצורך ביציבות שלטונית מזה והמעמד המיוחד של ממשלת המעבר מזה – נדרש איזון בין איפוק לבין עשייה, הכול בהתחשב בנסיבות העניין ובמציאות המשתנה. "השאלה שעקרונות הסבירות והמידתיות מציבים" – כך נכתב – "אינה אם העשייה היא שוטפת או חריגה. השאלה הנכונה הינה אם באיזון הכולל - המתחשב במכלול הנסיבות - נדרשים איפוק או עשייה" (שם, בעמ' 469).

3.ההחלטה נשוא העתירה שבפנינו נטועה עמוק בתחום ניהול יחסי החוץ וענייני הביטחון של מדינת ישראל. מ דובר בהחלטה בעלת אופי פוליטי בעיקרו. בכגון דא שמורה סמכות ההתערבות של בית משפט זה למקרים חריגים ביותר. כך הודגש בעניין וייס ובית משפט זה חזר על הדברים בפרשות נוספות, לרבות לאחרונה, בבג"ץ 9202/08 ח"כ לבנת נ' ראש הממשלה (לא פורסם, 4.12.2008). בעניין אחרון זה נשאלה השאלה אם רשאים ראש הממשלה וממשלתו – בתקופת ממשלת מעבר – לנהל משא ומתן מדיני עם סוריה ועם הרשות הפלסטינית. בית המשפט שב ועמד על חובתם של ראש הממשלה שהתפטר ושל הממשלה היוצאת לנהוג באיפוק ובריסון כמתחייב ממעמדם, אולם בא לכלל מסקנה כי: "נוכח שיקול הדעת הרחב המסור לראש הממשלה ולממשלה בתחום ניהול יחסי החוץ של ישראל ונטייתו של בית משפט זה שלא להתערב בתחום זה אלא במקרים חריגים, איננו סבורים כי עלה בידי העותרת להצביע על עילה של ממש להתערבות שיפוטית, כדי למנוע את המשך ניהול המשא ומתן המדיני ככל שזה מתקיים".

מסקנה זו יפה גם לענייננו. המשיבה מדגישה את התכליות המדיניות של המהלך של שחרור אסירים. לדבריה, אין מ דובר אלא בחלק מן המשא-ומתן עם הרשות הפלסטינית. המשיבה מפנה לשורה ארוכה של החלטות שבהן נדחו עתירות הנוגעות לשחרור אסירים לאור האופי המדיני המובהק של ההחלטה (ראו לאחרונה בג"ץ 7280/08 אלמגור נ' ממשלת ישראל (לא פורסם, 24.8.2008)).

העותרת גורסת כי המקרה שלפנינו מתייחד בכך שהמשיבה אינה נושאת באחריות (accountability) לתוצאות החלטתה, כיוון שהיא על-סף סיום הכהונה. לכך ניתן להשיב באותה מטבע כי דווקא לנוכח מועד הבחירות הקרב ובא, מתחדדת המסקנה כי החלטה זו, כמוה כמו החלטות אחרות הנוגעות לניהול המהלכים המדיניים והביטחוניים של מדינת ישראל, תעמודנה למשפט הציבור, ולא בעתיד הרחוק כי אם בתוך זמן קצר. משפט הציבור ניצב, איפוא, באורח מוחשי, למול עיניה של המשיבה. מכל מקום, כאמור, בנסיבות העניין ולאחר שבחנו את טענות העותרת כולן, לא מצאנו עילה משפטית להתערב בהחלטה נשוא העתירה והתוצאה היא שיש לדחות את העתירה.

סוף דבר, העתירה נדחית.
