המשנה לנשיאה א' ריבלין:

1.החוק לפיצוי נפגעי גזזת, התשנ"ד-1994 (להלן: החוק), בא לפצות אנשים שטופלו בעבר באמצעות הקרנה כנגד מחלת הגזזת, וחלו לאחר-מכן במחלות שונות שמחקרים מצאו קשר בינן לבין טיפול כאמור. המחלות מנויות בתוספת לחוק, ונכללים בהן גידולים שונים, סרטן הדם וחוסר שיעור באזורי הצטלקות בעור הקרקפת. שר הבריאות, לפי סמכותו בסעיף 13 לחוק, חתם בזמנו על צו המורה להוסיף לרשימה שבתוספת מחלה נוספת – גידולים שפירים בבלוטת התריס. הצו לא פורסם ברשומות, ועד היום לא נכללת המחלה ברשימה, כיוון שלא נמצא לכך כיסוי תקציבי.

מכאן העתירה שבפנינו. העותרים מתארים את מכלול הנזקים שנגרמו לאנשים שטופלו בהקרנה כנגד מחלת הגזזת, ובפרט, את הקשר שבין הטיפול בהקרנה לבין התפתחות גידולים שפירים בבלוטת התריס. לשיטתם, הסמכות להוסיף מחלות לרשימה שבתוספת נתונה לשר הבריאות, ומשזה האחרון ראה לנכון לחתום על הצו, אין עוד מקום לכך שמשרד האוצר יטרפד את מימושו. ההימנעות מקידום הצו, לדידם, גורמת עוול לחולים, מפלה אותם לרעה ופוגעת בזכויותיהם.

טענות העותרים נוגעות ללב ויש בהן טעם, אך לאחר שבחנו את טענות הצדדים לא ראינו מנוס מדחיית העתירה.

2.המדינה אינה חולקת על כך שנמצא קשר בין השכיחות של גידולים שפירים בבלוטת התריס לבין קבלת הטיפול בהקרנה. לדברי המדינה, בדיקות אפידמיולוגיות שנעשו "הראו כי הסיכון היחסי ללקות בגידולים שפירים בבלוטת התריס בקרב מי שקיבלו הקרנות כנגד גזזת, גדול פי שניים מסיכון זה בקרב שאר האוכלוסייה. ממצאים אלו" – מוסיפה המדינה ומבהירה – "עלו בקנה אחד עם ממצאיהם של מחקרים רבים אשר נערכו בעולם והוכיחו את הקשר הסיבתי האמור". תשתית מחקרית זו היא שעמדה ביסוד עמדתו של שר הבריאות דאז, להוסיף מחלה זו לרשימה שבתוספת. אלא שחרף כך, היישום מתעכב, ולעת הזו, טרם נמצא הכיסוי התקציבי הדרוש.

3.אין ספק כי משנחקק החוק – אפילו אם, כטענת המדינה, החוק מעניק תגמולים "לפנים משורת הדין" – המצב האופטימאלי הוא להכניס בגדרו את כל המחלות שנמצא קשר סיבתי בינן לבין הטיפול בהקרנה; ודאי כך ככל שמדובר במחלות חמורות וקשות. אכן, עצם העובדה שמדובר בחוק בעל גוון סוציאלי ומיטיב, אין משמעותה, מניה וביה, כי כל הבחנה בין החולים תעלה בקנה אחד עם עקרונות מקובלים ובכללם עקרון השוויון. המדינה בתגובתה כותבת כי רשימת המחלות שבתוספת משקפת את תוצאות המחקר שנערך החל משנות ה- 60 על-ידי פרופ' מודן ז"ל, אולם נראה שמחקרים חדשים בתחום עשויים להצריך בחינה מחודשת של הרשימה ועדכונה.

מצד שני, יש להכיר בכך שבכגון דא, הרצוי אינו תמיד המצוי, ובין השיקולים שלעניין קיים גם השיקול התקציבי. אין למעשה מחלוקת כי החוק אינו נותן מסגרת לפיצוי בגין כל התופעות והנזקים שניתן לקשרם לטיפול בהקרנה. החוק תוחם את הזכאות למחלות מסוימות שגרמו נכות מסוימת. הרחבת היקף הזכאות מצריך השקעה תקציבית. לעניין זה מורה סעיף 40(א) לחוק יסודות התקציב כי על-מנת לקדם חקיקת משנה הכרוכה בהוצאות, נדרש תקצוב מתאים. עד כה, חרף מאמצים שנעשו על-ידי גורמים שונים, טרם הוקדש נתח מתקציב המדינה לצורך הכללת החולים בגידול שפיר בבלוטת התריס במסגרת הזכאות המוקנית לפי החוק. בהקשר זה יש להוסיף ולציין מספר נתונים נוספים: ראשית, הזכאות מכוח החוק איננה מותנית בהוכחת קשר סיבתי אינדיבידואלי בין הטיפול בהקרנה לבין המחלה. החוק מניח קשר כזה בבחינת חזקה חלוטה. שנית, הרשימה שבתוספת כוללת מחלות שלדעת הגורמים הנוגעים בדבר הן מחלות בדרגת חומרה מסוימת. במסגרת תקציב מוגבל, תיתכן מדיניות המייחדת חוק מהסוג הנדון למחלות בעלות אופי וחומרה מסוימים, כאשר לגבי חולים אחרים, תעמוד זכות תביעה לפי חוקים אחרים (כגון חוק הביטוח הלאומי). הדברים מקבלים משנה תוקף לנוכח הבהרת המדינה כי מאז נכנס החוק לתוקפו, שולמו תגמולים בשיעור העולה במידה משמעותית על הצפי המקדמי, וכי הוספת המחלה שבנדון לרשימה שבתוספת משמעותה תוספת עלות גבוהה ביותר.

4.את כל אלה צריכה לשקול הרשות המוסמכת. עליה לבחון את ההצדקה להכניס בגדר החוק את המחלה של גידולים שפירים בבלוטת התריס, או כל מחלה אחרת, תוך התחשבות במכלול השיקולים לרבות השיקול התקציבי. "חוק שלביצועו יש גם היבט תקציבי אינו יכול להתפרש במנותק מן המגבלות ומן האילוצים התקציביים" (בג"צ 3627/92 ארגון מגדלי הפירות בישראל נ' ממשלת ישראל, פ"ד מז(3) 387). "אין רשות הפועלת בחברה על-פי חוק הרשאית והיכולה להתעלם מאילוצי תקציב ולספק שירותים ללא חשבון, ותהא חשיבותם של השירותים רבה וחיונית ככל שתהא" (בג"צ 3472/92 ברנד נ' שר התקשורת, פ"ד מז(3) 143). מקום בו מ דובר בענייני בריאות, האיזון עשוי להיות קשה במיוחד. ההבחנה בין הזכאי לזה שאינו זכאי עשויה להיות קשה וכואבת. אך בהתחשב באופיו של החוק נשוא דיוננו ובגישה המרוסנת המחייבת את בית המשפט עת שדנים אנו במדיניות כלכלית ובשיקולים תקציביים, לא מצאנו עילה להתערבותנו. עם זאת, נעיר בשולי הדברים, כי בנסיבות העניין, ומשהשר עצמו ראה לנכון לחתום על צו המורה להוסיף לרשימה את המחלה נשוא העתירה – חזקה עליו כי יבחן מחדש את האפשרות לקדם כוונתו זו בהתקיים התנאים לכך בעתיד.

העתירה נדחית. בנסיבות העניין אין צו להוצאות.
