1.הורתה של העתירה שבפנינו בתביעה שהוגשה על ידי העותרים, תושבי מצרים, ל בית המשפט המחוזי בחיפה (ת"א 449/00) לפסק דין המצהיר על זכאותם להירשם כבעלים של מספר חלקות קרקע באזור רמלה, בשטח כולל של כ-74 דונם (להלן: המקרקעין), ולחילופין, כי הם זכאים לפיצוי בגין הקרקע על פי חוק נכסי נפקדים, תש"י-1950 (להלן: החוק). התביעה נדחתה בפסק דינו של כב' השופט ג'רגורה מיום 28.4.93, מן הטעם שהעותרות לא הוכיחו את זכויותיהן במקרקעין (להלן: פסק הדין). וכך נאמר בפסק הדין:
"הוראות החוק היבשות והנוקשות, לרבות דיני הראיות, עמדו מחסום בפני להיעתר לתביעה. ב"כ התובע לא הוכיח את שרשרת הבעלות מצד אחד, ולא הוכיח את המסמכים על פיהם הועברה הקרקע מהמנוח לבני הזוג. ב"כ התובעים לא המציא צו ירושה, כפי שטען שימציא".
למרות דחיית התביעה בהיעדר ראיות מספיקות בדבר זיקתם של העותרים למקרקעין, עמד בית המשפט המחוזי בהרחבה על תכליתו של החוק ובשולי פסק הדין, אף המליץ לאפוטרופוס על נכסי נפקדים "להפעיל את שיקול דעתו ולמצוא את הדרך הראויה לפצות את התובעים בגין זכויותיהם בקרקע בישראל".
2.העותרים הגישו ערעור על פסק דינו של בית המשפט המחוזי (ע"א 5083/03). בהחלטת בית המשפט בעקבות הדיון מיום 7.7.05 הומלץ לעותרים למשוך את הערעור ללא צו להוצאות ולפנות לאפוטרופוס לנכסי נפקדים, כאמור בס' 27 או 28 לחוק, ומבלי שיש בהמלצה משום הבעת דיעה של בית המשפט באשר לסיכוייה של פניה כזו.
בעקבות המלצת בית המשפט, משכו המערערים את ערעורם ופנו לאפוטרופוס על נכסי נפקדים. פנייתם של המערערים נדחתה "לאור תקדימיות הפניה והשלכות הרוחב שהיא יוצרת מחד, מול אי ייחודיותה ממקרים אחרים של נכסי נפקדים, דבר שאיננו מאפשר לאבחנה מן הכלל מאידך" (מכתב האפוטרופוס מיום 13.11.05).
3.בעקבות דחיית פנייתם, הגישו המערערים ביום 29.12.05 את העתירה דכאן ובה עתרו, בין היתר, ליתן צו המורה למשיבים ליתן טעם מדוע האפוטרופוס לנכסי נפקדים לא נותן אישור בכתב שהעותרים אינם נפקדים על פי סמכותו לפי ס' 27 לחוק, מדוע לא שחרר לידי העותרים את המקרקעין לפי ס' 28 לחוק, ומדוע הועדה לנכסי נפקדים לא המליצה על שחרור נכסי המקרקעין לידי העותרים.
בהחלטת בית משפט זה מיום 16.04.08, הומלץ כי עניינם של העותרים יובא שוב בפני הועדה המייעצת על-פי סעיף 29 לחוק, כי העותרים יהיו רשאים להעלות בפני הועדה כל טענה שהיא, כי הועדה תשקול מתן אפשרות לבא-כח העותרים להשמיע טענותיו בפניה, ולאחר סיום ההליך בפני הועדה תובא ההמלצה לאפוטרופוס למתן החלטתו.
4.בהמשך להחלטה זו פנו העותרים לאפוטרופוס, ובמענה לדרישתו כי ימלאו טופס בקשה ויוכיחו את בעלותם במקרקעין ואת שרשרת העברת הזכויות, השיבו כי יש לראות בעתירתם לבג"ץ את הבקשה מטעמם (מכתבו של ב"כ העותרים מיום 12.5.08). פנייתם של העותרים הועברה לועדה המייעצת לפי סעיף 29 לחוק, ונדחתה בהחלטתה של הועדה מיום 1.7.08 בה נאמר "הועדה החליטה לדחות את הבקשה מהטעם שהמבקשים לא הוכיחו את זיקתם לנכסים המדוברים. מעבר לכך, אין בעובדות מקרה זה כדי להיות טעם מספיק אשר יביא את הועדה להחליט על המלצה לשחרור הנכס".
לאור החלטת הועדה חזרו העותרים והגישו עתירה מתוקנת, וזו עומדת בפנינו.
5.העותרים פרשו בעתירתם את טענותיהם לבעלות במקרקעין מכוח מורישם, הפליגו במישור המשפטי לתכליתו ולפרשנותו של החוק על רקע חוקי היסוד וזכות הקניין, ונדרשו להגדרות של "נפקד" ולפרשנות סעיפים 29-27 לחוק.
אומר בקצרה, כי איננו נדרשים לדון בשאלות נכבדות אלה, ודין העתירה להידחות מן הטעם הפשוט שהעותרים לא הוכיחו את זיקתם למקרקעין, כפי שנקבע בפסק הדין המהווה מעשה בית דין בנושא זה. העתירה דכאן אינה האכסניה המתאימה לערער או להרהר אחר התוצאה הסופית של פסק הדין תוך העלאת טענות עובדתיות שכבר נדונו בהליך האזרחי ב בית המשפט המחוזי בפסק דין חלוט.
6.המלצתו של בית משפט זה כי הועדה תחזור ותשקול את עניינם של העותרים, נעשתה מתוך הנחה שאם ימציאו העותרים ראיות ומסמכים נוספים לביסוס זיקתם למקרקעין, תחזור הועדה ותשקול שוב את עניינם. ברם, משהודיעו העותרים כי אין ברשותם מסמכים נוספים מעבר לאלו שצורפו לעתירה, רשאית הייתה הועדה לקבוע, כפי שנקבע גם בפסק הדין, כי העותרים לא הוכיחו זיקתם למקרקעין. משלא הוכיחו העותרים תנאי סף זה, איננו נדרשים לנימוק הנוסף של הועדה כי לא מדובר במקרה ייחודי המצדיק המלצה לשחרור המקרקעין, ואיננו נדרשים לטענת המשיב כי המקרקעין כבר הועברו לצדדים שלישיים לפי סעיף 17 לחוק או כי העותרים לא נופלים מלכתחילה בגדרו של סעיף 1(ב)(1)(III) לחוק וממילא אין תחולה לסעיף 27 לחוק.
7.אשר על כן, דין העתירה להידחות, ובנסיבות העניין, והרבה לפנים משורת הדין, ללא צו להוצאות.
