פסק-דין

1.בעתירה דנא, שהוגשה בשנת 2011, ביקשה העותרת כי המשיבים 3-1 יפעילו את סמכויותיהם ויביאו להעברה מן התפקיד של המשיב 5, יושב ראש הדירקטוריון של קופת חולים מאוחדת ומנכ"ל זמני שלה. במהלך השנים מאז הגשתה של העתירה חלו שינויים שונים בקופת חולים מאוחדת, ונזכיר מיד את האחרון שבהם.

2.לאחרונה, ביום 30.3.2014, החליטה שרת הבריאות (שבאה תחת ראש הממשלה שכיהן בתפקיד שר הבריאות בממשלה הקודמת, בעת הגשתה של העתירה) למנות לקופת חולים מאוחדת דירקטוריון זמני חליף, כולל יושב ראש חדש. ברור, שעם קבלתה של ההחלטה האמורה, נתייתרה העתירה שבפנינו.

3.ביום 6.4.2014, הוגשה על ידי קופת חולים מאוחדת וחלק מחברי הדירקטוריון עתירה נגד החלטתה הנזכרת של שרת הבריאות (בג"ץ 2520/14). ביום 13.4.2014 דחה בית משפט זה (השופט א' שהם) בקשה ליתן צו ביניים בעתירה החדשה. משמעות הדבר היא שהדירקטוריון המחליף ממשיך לכהן עתה. אכן, אם תתקבל העתירה החדשה ייתכן שהסעד המבוקש בעתירה הנוכחית יחזור ויהיה רלוונטי. ברם, המקום להתמודד עם האפשרות שתבוטל החלטתה של השרה מיום 30.3.2014 הינה העתירה החדשה ולא העתירה הנוכחית משנת 2011.

4.אי לכך העתירה שבכותרת נמחקת, לאחר שלמעשה הושגה מטרתה לעת הזו. כמובן שלעותרת שמורות זכויותיה וטענותיה.
