אין בעתירה זו ממש. אפילו היה בה ממש ראוי היה שהעותרת תבקש למוחקה טרם הדיון. ברי, כי משרד הבריאות, הוא המשיב, רשאי להעביר לידי הגוף שהחליף את העותרת כנציג בישראל של חברת Hospira, את החומר המצוי בידיו לגבי תכשיר מסוים, שהעותרת הייתה לגביו "בעלת הרישום".
על כן, העתירה נדחית. העותרת תישא בשכר טרחה בסך 20,000 ש"ח לטובת המשיב, ובסכום של 10,000 ש"ח לטובת Hospira, שביקשה להצטרף להליך.
