השופט י' עמית:

1.העותר, תושב רצועת עזה במקור, נשוי לאזרחית ישראלית ולהם 7 ילדים כולם אזרחי ישראל. העותר מבקש להורות למשיבים ליתן טעם מדוע לא יבוטל צו ההרחקה שהוצא נגדו ומדוע לא ינתן לו רישיון לישיבת ארעי מסוג א/5 או מכל סוג אחר, בשל נסיבות אישיות מיוחדות או מטעמים הומניטאריים.

2.דין העתירה להדחות על הסף.

עניינו של העותר נדון בפני בית משפט זה מספר רב של פעמים החל מאמצע שנות התשעים. התמונה העולה מהעתירות הקודמות היא כי העותר קשור לפעילות פלילית ענפה, חלקה אף על רקע בטחוני, ובגינה נדחו עתירות קודמות שהוגשו על ידו.

וכך נאמר בפסק הדין מיום 17.5.2012 בעתירה שהגיש העותר בבג"ץ 4692/10:

"שמענו את טעוני הצדדים, בהסכמת בא כוח העותר עיינו בחומר החסוי ושאלנו את גורמי הביטחון והמשטרה שאלות הבהרה.

הבהרנו את עמדתנו החד משמעית שעליהם לבוא בדברים עם גורמי הפרקליטות והמשטרה, על מנת לנסות לגבש חומר חקירה ולבחון אפשרות הגשת כתב אישום נגד העורר שהמעשים המיוחסים לו הם קשים ביותר.

בהמלצתנו חזר בו בא כוח העותר מהעתירה. הצו הארעי המונע את גרושו שניתן על ידי בית משפט זה מיום 25.4.12 יעמוד בעינו עד יום 1.7.12. עד אז ייעשה מאמץ כאמור לגבש כתב אישום כנגד העותר".

לאחר הדברים האלה, חזר העותר ועתר לבית משפט זה בבג"ץ 6624/12. בפסק הדין מיום 5.2.2013 נדחתה העתירה בשל מעשה בית-דין, לאור פסק הדין שניתן ביום 17.5.2012 בבג"ץ 4692/10 הנ"ל. וכך נאמר בפסק הדין בבג"ץ 6624/12:

"לאחר שנערך דיון ביום 17.5.2012, חזר בו דברי מעתירתו [הכוונה לעתירה בבג"ץ 4692/10 – י"ע] בהתאם להמלצת בית המשפט שעיין בחומר החסוי בעניינו. כן הורה בית משפט זה כי על המשיבים 'לבוא בדברים עם גורמי הפרקליטות והמשטרה, על מנת לנסות לגבש חומר חקירה ולבחון אפשרות הגשת כתב אישום נגד העותר שהמעשים המיוחסים לו הם קשים ביותר'. כתב אישום כאמור לא הוגש, אולם בהליכים שננקטו לאחר ההחלטה מיום 17.5.2012, נקבע כי 'אי הגשת כתב אישום נגד העותר אינה מקימה לו עילה או זכות להמשיך ולשהות בישראל...'.

[ ] ...ככל שלא ארע כל שינוי נסיבות מהותי מעת סיום ההליך בבג"ץ 4692/10, הרי שכטענת המדינה – הנושא הוכרע, קיים לגביו מעשה בית דין ואין מקום להידרש לו שנית ....זאת, אף אם העותרים בעתירה דנא לא היו חלק פורמאלי מעתירתו של דברי, שכן אין זה ראוי כי מחלוקת משפטית זהה תידון פעם אחר פעם רק בשל חילופי גברא ברמת העותר...

[ ] ואולם, אם אכן, כפי טענת העותרים, אירע שינוי בנסיבותיו של המקרה, מן הראוי שהעניין יובא על ידי דברי עצמו, ולא על ידי משפחתו. לצד זאת יצויין, כי על פני הדברים אין העתירה מגלה שינוי נסיבות כאמור, על כל המשתמע מכך.

העתירה נדחית. על אף שייתכן והיה מקום ליתן צו להוצאות, החלטנו להימנע מכך בנסיבות העניין".

3.טרם יבשה הדיו על פסק הדין מיום 5.2.2013, חזר ועתר העותר ביום 20.3.2013 בעתירה דכאן, בטענה לשינוי נסיבות הנובע מאי הגשת כתב אישום כנגדו.

דין הטענה להידחות באשר בית משפט זה לא הורה בפסק הדין בבג"ץ 4692/10 להגיש כתב אישום כנגד העותר, אלא הורה לבחון את האפשרות להגיש כנגדו כתב אישום. כפי שעולה מהודעות של המשיבים בעתירות קודמות שהגיש העותר, ננקטו מספר פעולות על ידי הגורמים הרלבנטיים במשטרת ישראל, אך נמצא כי לא קיימות ראיות גלויות המאפשרות את העמדתו של העותר לדין. בית משפט זה קיבל עמדת המשיבים כי אין לאפשר המשך שהייתו של העותר בישראל, ואף הורה בשל חומרת מעשיו לבחון הגשת כתב אישום בעניינו ומיצוי הדין כלפיו. קשה להלום כי העותר ייבנה מחומרת מעשיו, אשר בגינם מסרבים המשיבים ליתן לו מעמד. מכל מקום, אם בבג"ץ 6624/12 נדחה עניינו של העותר עקב מעשה בית דין, על אחת כמה וכמה יש לדחות העתירה כאן בשל מעשה בית דין, ואזכיר כי העתירה הוגשה פחות מחודשיים לאחר מתן פסק הדין מיום 5.2.2013.

4.אשר על כן, אנו דוחים את העתירה, ומבטלים צו הארעי מיום 20.3.2013. בנסיבות העניין, אנו מחייבים העותר בהוצאות המשיבים בסך 5,000 ₪.
