השופט י' עמית:
1.ענייננו בעתירה כנגד מינויו של המשיב לשופט בית המשפט העליון בעקבות החלטתה של המשיבה מיום 6.1.2012 לבחור בארבעה מועמדים, ביניהם המשיב, לכהונת שופט ב בית המשפט העליון.
בעתירה מתבקשת המשיבה "לבוא וליתן טעם מדוע לא יקבע כי מתנחל בשטחים הכבושים אינו ניחן בטוהר המידות הנדרש לשופט ב בית המשפט העליון, וכך בחירתה ב נעם סולברג מתנחל בסביבות שכם, לכהונה ב בית המשפט העליון, הינה החלטה פסולה ודינה להתבטל". כן נתבקש צו ביניים המורה כי עד להכרעה בעתירה לא ימונה המשיב לכהונתו כשופט בית משפט עליון.
בעתירה נטען, בין היתר, כי התנחלותו של המשיב בשטחים הכבושים אסורה על פי דין "והיא כשלעצמה מעשה דוחה מבחינה מוסרית" הפוסל את המשיב מלכהן כשופט בכל ערכאה שיפוטית ובמיוחד כשופט ב בית המשפט העליון.
2.דין העתירה להידחות על הסף.
העותרת הציגה הסתייגותה ממועמדותו של המשיב לחברי המשיבה מבעוד מועד, וכפי שנכתב במכתבה של גב' יפה מור, מנהלת אגף תנאי שירות לשופטים והוועדה לבחירת שופטים מיום 14.11.2011, ההסתייגות הועברה לעיון חברי הוועדה, שחזקה עליהם כי עניין מקום מגוריו של המשיב עמד בפניה.
3.למעלה מן הצורך אציין, כי חזרתי ועיינתי בחוק יסוד: השפיטה ולא מצאתי כי מקום מגוריו של המשיב באלון שבות (בגוש עציון ולא "בסביבות שכם" כפי שנכתב בעתירה) מהווה עילה או מניעה לכהונתו של שופט, לרבות שופט בית משפט עליון. לא למותר לציין כי המשיב מכהן מזה שנים רבות כשופט, אך כפי שציינו העותרים עצמם לא עלתה בענין זה על ידם כל טענה נגד המשיב עד עתה.
אף לא מצאתי תקדים משפטי לפיו מקום מגורים כאמור מהווה פגיעה בטוהר המידות בכלל, ובטוהר המידות השיפוטי בפרט. העותרת לא הצביעה על תקדים כאמור, אך לשם הזהירות, חזרתי ועיינתי גם בכללי אתיקה לשופטים, תשס"ז-2007 ולא מצאתי כי מקום מגורים כאמור מהווה עבירה על כללי האתיקה.
