העתירה שלפנינו מתייחסת להארכת צו התפיסה שהוצא בשנת 2001 ל-5 שנים והוא חוצה שטח של העותרים המעובד על ידם, ובו מצויה דרך שרוחבה 10 מ' ואף גדר חוצצת בין החלקה הנמצאת ממזרח לאותה גדר והחלק המצוי ממערבה בסמיכות לבתי הישוב הר אדר.

בעתירתו טען העותר כנגד הארכת תוקף הצו לאחר שלטענתו המצב הבטחוני של הישוב אובטח באמצעות גדר הבטחון המצויה במרבית המקומות במרחק של כ- 300 מ' מבתי הישוב. עוד הביע בא-כוח העותרים חשש כי יש כוונה לספח את חלקת העותרים שממערב לדרך לישוב ולפגוע נוספות בעותרים.

בפנינו טען בא-כוח המדינה כי מדובר בהארכת המצב הקיים ולא בשינויו. על-פי תפיסת הבטחון המקוימת בישובים גם אלה הסמוכים לגדר ההפרדה, ישנה גדר המקיפה את הישוב. בא-כוח המדינה הצהיר לפנינו כי אין כוונה לספח את רצועת הקרקע של העותרים, וכי יש כוונה לאפשר להם להמשיך לעבד כפי שעיבדו עד כה. יצוין כי בעבר היה לעותר 1 מפתח לשער החקלאי שאיפשר לו גישה לקרקעותיו, מפתח זה נלקח ממנו משום מה, אף כי לא היתה שום הפרה מצידו של ההסדר במשך השנים בהן החזיק במפתח. לא מצאנו עילה לשלילת החזקת המפתח מהעותר, על-פי הסדר שנהג עמו משך השנים ומן הראוי כי הסדר זה יימשך.

נוכח הכוונה להשאיר את המצב הקיים - דרך וגדר משנית לגדר ההפרדה – בהתחשב בכך שהחלטת המפקד הצבאי היא על-פי תפיסת הבטחון המקובלת להגנה על הישובים באזור, ובשים לב לפגיעה המזערית שנוהגת כבר מספר שנים ביחס לקרקעות העותר תוך תיאום עמו, וכן בהתחשב בכך שמדובר בצו זמני שהוארך עד 31.12.09, לא ראינו להתערב לביטול הצו. רשמנו לפנינו את הודעת בא-כוח המדינה כי שטחיו של העותר מצידה המערבי של הדרך לא יפגעו עוד מעבר לפגיעה שכבר נעשתה ובגינה אין חולק שהוא זכאי לפיצוי כספי. אנו מניחים כי מפתח השער החקלאי יוחזר לעותר.
