השופט א' א' לוי:

העותרים הם תושבי ארצות הברית, אשר פנו אל המשיב בבקשה לקבלת אזרחות ישראלית מכוח הוראותיו של חוק השבות, התש"י-1950. את דחיית הבקשה נימק המשיב כך:

"בהסתמך על המידע שהעברתם אין אנו מוצאים מקום לאשר הבקשה, שכן מ דובר בסייגים לחוק השבות" (מכתב מיום 2.3.2010).

נטען כי פניות נוספות של העותרים אל המשיב לא נענו, ולכן הגישו את עתירתם בה ביקשו לחייב את המשיב לנמק את סירובו. בתגובתו לעתירה הסביר המשיב כי בידיו מצוי מידע לפיו העותרים אינם עומדים בקריטריונים שנקבעו בסעיף 4ב לחוק השבות, הואיל והם גם בני דת אחרת (יהודים משיחיים). על כך השיבו העותרים כי הם מבקשים להותיר את עתירתם על כנה, כדי לאפשר להם לפעול לשינוי החלטתו של המשיב, משנודע הנימוק שעומד בבסיסה. עוד ביקשו העותרים להורות למשיב לבחון את עניינם בשנית, ובכלל זה לזמנם לחקירה ולאפשר להם לשטוח את טענותיהם בפניו. זאת לגישתם לצורך "ניצול המומנטום" שנוצר בשל הגשת העתירה הנוכחית, וכדי לחסוך את תשלומה של אגרה נוספת.

לכך אין בידנו להיעתר. משנתקבל הסעד שהתבקש במלואו, היינו ההנמקה להחלטה, שוב אין כל צורך בעתירה ודינה להידחות. ככל שהעותרים יהיו סבורים בעתיד כי עומדת להם עילה לקבלתו של סעד אחר, פתוחה בפניהם הדרך לשוב ולפנות לבית המשפט.

העתירה נדחית.

בנסיבות העניין אין צו להוצאות.
