השופט ח' מלצר:

1.העותר, כבן 70 שנה, מתגורר עם דודתו בדירה ב קרית גת (להלן: הדירה). המשיבה 5 עתרה בשנת 2001 לבית משפט השלום בבאר שבע לסעד הצהרתי לפיה היא בעלת הזכויות בדירה, ותובענתה נתקבלה בפסק דינו של כב' סגן הנשיא י' שפסר (להלן: פסק הדין הראשון). העותר ערער על פסק הדין לבית המשפט המחוזי בבאר שבע, וערעורו נדחה (כב' סגנית הנשיא ש' דברת והשופטים ר' ברקאי ו- א' ואגו). הוא הגיש עתירה לבית משפט הגבוה לצדק כנגד פסקי הדין הנ"ל, ועתירתו נדחתה (בג"ץ 6503/10, השופטים א' חיות, י' דנציגר ו- ע' פוגלמן). העותר הגיש אף בקשת רשות ערעור על פסק דינו האמור של בית המשפט המחוזי, ובקשתו נדחתה (רע"א 6506/10, השופט א' רובינשטיין). חרף האמור, לא פינה העותר את הדירה. המשיב 6, שרכש בינתיים את הזכויות בדירה מן המשיבה 5, הגיש איפוא לבית משפט השלום בבאר שבע תובענה בסדר דין מקוצר לסילוק ידו של העותר מן הדירה, על יסוד פסק הדין הראשון. העותר ביקש להתגונן כנגד התובענה בטענה כי פסק הדין הראשון הוא הצהרתי בלבד, אך בית המשפט (כב' הרשם ע' כפכפי) דחה את הבקשה ונתן פסק דין לפינוי כמבוקש (להלן: פסק הדין השני). ערעור המבקש על פסק הדין השני – נדחה על ידי בית המשפט המחוזי בבאר שבע (כב' סגנית הנשיא ש' דברת והשופטים ר' ברקאי ו- א' ואגו). בקשת רשות על פסק הדין נדחתה על-ידי בית משפט זה, בשבתו כבית משפט לערעורים, בתאריך 4.5.2011 (רע"א 924/11, השופט י' דנציגר). עתה מבקש העותר כי בית משפט זה, בשבתו כ בית המשפט הגבוה לצדק, יתערב בפסק הדין השני ובמכלול ההחלטות השיפוטיות שניתנו בעקבותיו, וזאת כיוון שלשיטתו הערכאות השונות לא עשו מלאכתן השיפוטית נאמנה.

2.דין העתירה – להידחות. מצוקתו של העותר מובנת, ברם אין בה כדי להצדיק התערבות של בית משפט זה בפסק הדין השני, או בהחלטות השיפוטיות הקודמות. כידוע, בית המשפט הגבוה לצדק אינו יושב כערכאת ערעור נוספת על החלטותיהם ופסקי דינם של בתי המשפט האזרחיים, ומקל וחומר שלא על החלטותיו שלו בשבתו כבית משפט לערעורים אזרחיים (ראו לאחרונה: בג"ץ 3344/11 Anton Hubner GmbH & Co. KG נ' בית המשפט העליון בשבתו כבית משפט לערעורים אזרחיים והאסמכתאות שם (לא פורסם, 5.5.2011)).

3.נוכח כל האמור לעיל – העתירה נדחית על הסף. ממילא זה דינה של הבקשה לסעד ביניים שבגדרה. יצוין כי נוכח העובדה שהעותר ראה לנכון להגיש את עתירתו דנן לאחר שהטריח כבר חמש ערכאות שיפוטיות שונות בניסיון להתנער מתוצאותיו של פסק הדין הראשון, היה מקום להשית על העותר הוצאות הולמות, אולם אם לא עשינו זאת הפעם הדבר נובע רק ממצבו הכלכלי הקשה של העותר, כנטען.
