העתירה שלפנינו הופנתה כנגד צו המעצר המנהלי שהוצא כנגד העותר ב-19.1.2009 ובו נקבעה תקופת המעצר המנהלי עד ליום 26.7.2009. העותר נידון בעבר בגין ביצוע פיגועי מטען וירי במסגרת חוליית גא"פ וריצה עונש מאסר בן ארבע שנים עד ליום 29.6.2008. זמן קצר ביותר לאחר שחרורו מהמאסר הורה המשיב על מעצרו המנהלי ל-6 חודשים ולאחר מכן בינואר הוארך ב-6 חודשים נוספים. ערכאת הביקורת הצבאית וכן ערכאת הערעור דחו את השגותיו על צו המעצר המנהלי האחרון בשל המידע שנפרש בפניהן בחומר החסוי.

בהסכמת בא-כוחו של העצור עיינו גם אנחנו בחומר החסוי במעמד צד אחד ולא מצאנו עילה להתערבותנו בהחלטה. מהחומר עולה במידע מודיעיני ברמה משכנעת של ראיות מנהליות כי עם שחרורו מהכלא חזר העותר לפעילותו בארגון והיה מעורב בתכנון פעילות צבאית ובפעילות בקשר לסחר באמל"ח. בשים לב לאופי הפעילות ובהיותה קשורה לפעילי גא"פ לאחר שהוצגה תשתית של ראיות מנהליות לפיה בשחרורו מהווה העותר סכנה של ממש לביטחון, לא ראינו להיעתר לעתירה.

העתירה נדחית.
