רקע

א. עניינה של העתירה החלטתו של המנהל לפי סעיף 7 לפקודת הסמים המסוכנים [נוסח חדש], התשל"ג-1973 (להלן המנהל) להתלות את רשיונו של העותר להחזיק ולהשתמש בסם מסוכן לצרכים רפואיים. כן עוסקת העתירה באופן קבלת הסם – האם בדרך של עישון או בדרכים אחרות, כפי שיפורט, והכל על רקע כניסתו הצפויה של העותר למאסר.

ב. העותר הורשע בבית משפט השלום באילת (ת"פ 39579-07-11) בגידול, ייצור והכנה של סם מסוכן ונגזרו עליו, בין היתר, עשרה חודשי מאסר בפועל. בערעור על חומרת העונש, העמיד בית המשפט המחוזי את תקופת המאסר על שבעה חודשים. לבית המשפט המחוזי הוצג "רישיון להחזקה ושימוש בסם מסוכן" (להלן הרישיון) שצריכתו היא בדרך של עישון. לפיכך נקבע, כי על שלטונות הכלא למצוא פתרון נאות שיתאים לצרכי העותר. העותר פנה לשירות בתי הסוהר (שב"ס) כדי להסדיר את אופן השימוש בסם במהלך ריצוי העונש.

ג. במכתב תשובתו של רע"ן נרקולוגיה בשב"ס (מיום 25.3.12) נאמר, כי עם קליטתו של העותר בשב"ס יקבל טיפול במינון שנקבע לו, ב"עוגיה" ולא בעישון, בהתאם למקובל בשב"ס. בין העותר לבין שב"ס החל דין ודברים באשר לאופן השימוש בקנאביס. העותר טען, כי הדרך היעילה היחידה היא באמצעות עישון, ותמך דעתו במכתביו של ד"ר גרינפלד - רופאו. מנגד, ביקש שב"ס מן המנהל - ד"ר ברוך - את עמדתו המקצועית. משנודע למנהל כי העותר השתמש בסם עוד קודם למתן האישור - ביטל את אישורו (ביום 8.4.12), וזאת עד לדיווח מד"ר גרינפלד באשר למצבו הרפואי. לאחר חילופי דברים נוספים בין הצדדים, במכתב המנהל מיום 13.5.12 נכתב "עם כניסתו של מר עוזרי לכלא הוא יעבור הערכה עם רופאי שב"ס. באם ימליצו ... כי יש צורך לחדש את הטיפול בקנאביס אצל מר עוזרי, הם הונחו לרכוש/להשיר מאייד של חברת וולקנו (המאייד היחיד לשימוש קנאביס בעל אישור אמ"ר) ... כמו כן יפנו אליי בבקשה לחדש רישיונו". בהמשך, הבהיר שב"ס, כי לא יפעל בעניינו של העותר כל עוד אין לו רישיון. ביום 14.5.12 הודיע המנהל לבא כוח העותר, כי יחייב את שב"ס לרכוש תרסיס המכיל קנאביס, חלף המאייד. בתגובה הודיע שב"ס כי לא יפעל להשגת התרסיס, ואינו כפוף להמלצות המנהל. ביום 14.5.12 הוגשה עתירה זו.

ד. ביום 15.5.12 נתקבלה תגובת המשיבים, לפיה בכוונת המנהל לחדש את רשיונו של העותר, באופן שיתאים לנסיבותיו ובכלל זה מאסרו הצפוי. צוין, כי עמדתם של שב"ס ומשרד הבריאות היא, כי העותר יכול לקבל את הסם באופן פומי, קרי ב"עוגיה", במינון של 60 גרם בחודש, פעמיים ביום; לתגובה צורף תצהיר מאת רע"נ נרקולוגיה בשירות בתי הסוהר, וכן נאמר כי ד"ר ברוך המנהל אישר את תוכנה, ותצהירו צורף בהמשך. בהודעה מיום 16.5.12 הציע בא כוח העותר, בהתאם לעמדתו של ד"ר גרינפלד, כי ייערך ניסוי בן שבוע בו יקבל העותר את הסם ב"עוגיה", ולאחריו יוכל ד"ר גרינפלד לחוות דעה באשר ליעילותו של הטיפול.

הכרעה

ה. לאחר העיון איננו מוצאים להיעתר לעתירה. המצב עתה הוא, של נכונות המנהל כאמור להשיב לעותר את הרישיון. השאלה שנותרה היא, האם במאסרו יהיה הטיפול בו באמצעות "עוגיה" תחת האידוי שהוא נזקק לו כיום, ובקשת העותר היא לאפשר לו ניסוי של ה"עוגיה" בפיקוח רופאו בטרם יוחלט. המדינה התנגדה לכך, כאמור. והיא מטעימה כי רופאיה סבורים שה"עוגיה" תהוה פתרון לעת הזאת (הגם שד"ר ברוך בעבר נדרש לאידוי). בצדק ציין בא כוח המדינה, כי שירות בתי הסוהר הוא האחראי גם לבריאות האסירים. על כן אין מנוס מכך שהעותר יתייצב לריצוי מאסרו, וזאת ביום א' 3.6.12, בנתון לכך שעד יום 31.5.12 יוחזר לו הרישיון, והפרקליטות תוודא זאת. בהתייצבו יובא העותר לפני רע"ן נקרולוגיה בשב"ס להסדרת ה"עוגיות", ורע"נ נקרולוגיה מתבקש גם לעקוב יומיומית אחר מצבו של העותר. למען הסדר הטוב נציין, כי השיקול הרפואי הוא כמובן המכריע, ואם יתברר לשב"ס על פי רופאיו כי ה"עוגיות" אינן מספיקות, יהא עליו למצוא דרך חלופית. איננו נכנסים לשאלה אם במקרה כזה יתכן שימוש בתרסיס במרפאת בית הסוהר או במקום אחר שאיננו פוגע במדיניות שב"ס, המובנת בחינת פשיטא, של זהירות לעניין סמים. אנו מקוים כי ה"עוגיות" יפעלו את פעולתן כראוי. בנתון לכך נמחקת העתירה בלא צו להוצאות.
