עתירה כנגד החלטת משרד הרישוי שלא לחדש רישיון רכב בשל תקנה 281 ג לתקנות התעבורה, התשכ"א-1961) להלן: התקנות).

העותר, אשר אינו מיוצג, מבקש במסגרת עתירה זו את התערבות בית המשפט בהחלטת רשות הרישוי שלא להנפיק רישיון רכב, ולו זמני, לכלי רכב שבבעלותו הנטענת (הרכב רשום ע"ש אחת בשם אדרי והעורר צירף יפוי כוח מטעמה). הרכב בו מדובר הוא אוטובוס משנת ייצור 1988, במהלך 2006 שונה מבנה הרכב ושינויו אושר במשרד הרישוי תוך שינוי סוג רישיון הרכב ל"רכב משא איחוד מגורים". עם זאת, המשיך העותר, לשלם מידי שנה את אגרת רישוי הרכב, על מנת שיהיה באפשרותו לערוך לרכב מבחן כשירות תנועה (טסט). בסוף שנת 2008 ביקש העותר לערוך טסט לרכב אך נתקל בקשיים למצוא מוסך מורשה אשר יסכים לעשות כן. העותר המשיך לשלם את אגרת רישיון הרכב ובשנת 2012 הגיש, לטענתו, בקשה למשרד הרישוי לקבלת רישיון זמני על מנת לנסוע למוסך בעיר אחרת כדי לערוך לרכב טסט. לאחר כארבעה עשר חודשים השיב משרד הרישוי לעותר כי הוא אינו יכול לחדש את רישיון הרכב בשל תקנה 281 ג לתקנות, לפיה:"כלי רכב מיושן שרישיונו לא חודש במשך שנתיים מאז שפג תוקפו- רישיונו לא יחודש". העותר הגיש תביעה ל בית משפט השלום באילת ת"א 21514-09-11 (כב' השופט י' עדן) שדחה את תביעתו בשל חוסר סמכות עניינית לאור טענת המדינה כי הסמכות נתונה לבג"ץ. בשל כך מפנה העורר עתירתו ל בית משפט זה, ומבקש את "התערבות בית המשפט לתקן עוול שנעשה על ידי משרד התחבורה..."

2.דין העתירה להידחות על הסף, מן הטעם שלעותר עומד סעד חילופי של פנייה ל בית המשפט לענינים מינהליים, ויש להצר על כך שבדיון ב בית משפט השלום, נטען בטעות על ידי המדינה כי הסמכות נתונה לבג"ץ. העתירה נסבה על החלטה של רשות לפי תקנות התעבורה בעניין רישוי ובטיחות של רכב, והסמכות בעניין זה נתונה ל בית המשפט לעניינים מכוח סעיף 5 לחוק בתי משפט לעניינים מינהלים, התש"ס-2000, ופריט 14(א) לתוספת הראשונה, הקובע כלהלן:

"החלטה של רשות לפי פקודת התעבורה, לרבות החלטה בעניני רישוי ובטיחות של נהגים, רכב, שירותי אוטובוסים, שירותי מוניות והוראת נהיגה, למעט החלטות שר, ולמעט כל ענין שבסמכות בית משפט לתעבורה".

3.אשר על כן, העתירה נדחית.
