פסק-דין
1.בעתירה שבפנינו, שהוגשה ביום 9.6.2013, מבוקש כי נורה למשיבים 11 ו-12, הם הפרקליט הצבאי הראשי והיועץ המשפטי לממשלה, לפתוח בחקירה פלילית נגד המשיבים 10-1, שהינם מי שהיו שרים בממשלה ובעלי תפקידים בכירים בצה"ל ובשירות הביטחון הכללי. העתירה מייחסת לאלה מעורבות בפשעי מלחמה, שלפי הנטען בוצעו במלחמת לבנון השנייה, היינו בשנת 2006, במבצע "עופרת יצוקה" שאירע בסוף שנת 2008 ותחילת שנת 2009 וכן באירוע הימי עם האונייה מרמרה, בחודש מאי 2010.
2.דעתנו היא שיש לדחות את העתירה הן מטעמי סף והן לגופה. בדברינו על טעמי סף כוונתנו לשיהוי ולצירוף עניינים שונים בעתירה אחת. כאמור, העתירה הוגשה בשנת 2013. האירועים המועלים בה התרחשו בשנים 2006, 2009-2008 ו-2010. אין כל הסבר לכך שהעתירה הוגשה לאחר שחלפו מספר שנים מעת האירועים. נוסיף על כך, כי העתירה עוסקת בשלושה אירועים צבאיים שונים, שהתרחשו במועדים שונים וכאשר המעורבים בהם, שרים ובעלי תפקידים, אינם אותם אנשים (ולוּ בחלק מן האירועים). אף לגופם של דברים לא שוכנענו שיש בסיס לטענות. נסתפק אך בכך שלא בוסס קשר סיבתי מספק בין כל אחד מעשרת המשיבים הראשונים לבין אירועים ספציפיים שנטען כי יש בהם משום פשעי מלחמה.
3.אשר על כן, העתירה נדחית. העותר יישא בשכר טרחה בסך 10,000 ש"ח.
