השופט א' גרוניס:
1.לפנינו עתירה למתן צו על תנאי שיורה למשיבים ליתן טעם מדוע לא יוּתר לעותרים להגיש רשימת מועמדים לוועד המקומי של הישוב עין חצבה (להלן – הישוב) ולנציגות של הישוב במועצה האזורית תמר. העתירה הוגשה ביום 14.1.09 ואילו המועד המקורי שנקבע לבחירות הוא 20.1.09.
2.מן העתירה עולות העובדות הבאות: העותרים הינם תושבים מהמגזר הבדואי הרשומים בפנקס הבוחרים של הישוב. העותרים מתגוררים במרחק של כ- 800 מטרים מגדר הישוב. לטענת העותרים, נודע להם לראשונה על מועד הבחירות רק ביום 11.1.09, עת שמועמד לראשות המועצה האזורית הגיע למקום מגוריהם במסגרת מסע הבחירות. לפיכך, לא יכלו כלל העותרים או מי מהם להגיש את מועמדותם לבחירות האמורות. ביום 29.12.08 פורסמה הודעת מנהל הבחירות למועצה האזורית תמר, ממנה עולה כי הבחירות לוועד המקומי של הישוב ולנציגי הישוב במועצה האזורית לא יתקיימו ביום 20.1.09. זאת, הואיל ורק רשימת מועמדים אחת הגישה את מועמדותה.
3.לטענת העותרים, לא דאגו המשיבים 7-1 להודיע להם על קיום הבחירות ומנעו מהם בכך את האפשרות של הצגת מועמדותם של העותרים. לגרסת העותרים, מקפידים העותרים 5-1 לקרוא את כל המודעות הרשמיות התלויות בישוב במקומות המיועדים לכך שעה שהם נכנסים לישוב. עם זאת, העותרים 5-1 מעולם לא ראו מודעה בדבר קיומן של הבחירות. בנוסף, מעלים העותרים טענות שונות הנוגעות להתנהלות ועדת הבחירות, כולל טענות של ניגוד עניינים וכן טענות כלליות הנוגעות להפליית העותרים ובני קהילתם בקבלת שירותים מוניציפליים. הסעד המבוקש, כאמור, הינו מתן אפשרות לעותרים להציג את מועמדותם, או מועמדות מי מטעמם, בבחירות ביום 20.1.09.
4.דין העתירה להידחות על הסף. סעיף 150(א) לצו המועצות המקומיות (מועצות אזוריות), התשי"ח-1958 (להלן – הצו) קובע את המועד להגשת רשימות מועמדים, ומורה כי
"לא יאוחר מהיום ה-33 שלפני יום הבחירות, ביום ובשעות שיקבע מנהל הבחירות בהתייעצות עם ועדת הבחירות, יוגשו למנהל הבחירות רשימות מועמדים והצעות מועמדים".
המונח "בחירות" לעניין סעיף 150(א) הנ"ל מוגדר בסעיף 137 לצו, ולפיו:
""בחירות" – בחירות למועצה, לראשות מועצה לרבות בחירות מיוחדות או לועד מקומי לרבות בחירת נציגות...".
מכאן שהעותרים לא עמדו במועד הקבוע להגשת מועמדותם לבחירות. לעתירה אף לא צורפו מסמכים המעידים על פנייה כלשהי מטעם העותרים אל ועדת הבחירות או לכל גורם מוסמך אחר בבקשה להגיש מועמדות באיחור. אפשר שדי בכך על מנת לדחות את העתירה. עם זאת, גם אילו נעשתה פניה כזו והייתה נדחית, לא היה בכך כדי לסייע לעותרים. הלכה פסוקה היא כי ישנה חשיבות מיוחדת להקפדה על המועדים שנקבעו בדין לעניין קיום בחירות. נקבע גם כי "אינטרס של תקינות הבחירות וקיומן לפי לוח המועדים שנקבע בחוק עשוי לגבור על האינטרס של המועמד להיבחר..." (ראו, בג"ץ 11243/02 פייגלין נ' יושב-ראש ועדת הבחירות, פ"ד נז(4) 145, 153 (2003) והאסמכתאות הרבות שם). בנקודת הזמן בה אנו נמצאים, יומיים לפני המועד המתוכנן של הבחירות, ודאי שאין מקום ליתן את הסעד המבוקש. זאת ועוד, מן ההודעה שפורסמה על ידי מנהל הבחירות עולה כי נוכח העובדה שהוגשה רשימת מועמדים אחת בלבד לבחירות לוועד המקומי וכך גם לעניין הנציגות במועצה האזורית, לא תערכנה כלל בחירות בישוב ביום 20.1.09. ברור שגם לאור זאת, אין כל בסיס ליתן כיום סעד בעניין הגשת רשימת מועמדים.
5.לאור האמור, העתירה נדחית על הסף בלא שנתבקשה תשובה.
