1.העותרים, עמותה המייצגת את אוכלוסיית הנכים בישראל וחברים בה, מבקשים כי נורה למשיבה שלא למנוע מהם להיכנס ולצאת את המתחם שבחזית משרד הרווחה בקריית הממשלה בירושלים, שם מתקיימת הפגנה של ציבור הנכים בישראל. לטענתם, שוטרים המצויים במקום מונעים מנכים המשתתפים בהפגנה לצאת ממתחם ההפגנה.

העתירה הוגשה לבית משפט זה אתמול בשעות הערב המאוחרות ונתבקשה תגובת המשיבה לה.

2.המשיבה מבהירה כי ניתן לעותרים רישיון לקיום אסיפה ביום 10.6.08 בלבד. לדבריה, אתמול בשעות הצהריים החלו משתתפים באסיפה לגלוש מן המתחם שהוקצה להם אל תוך הכביש, באופן שסיכן את המשתתפים באירוע והפריע לתנועה. נוכח הסיכון הבטיחותי ועל רקע חוסר היכולת לוודא שהאסיפה תישאר בגבולות המתחם שנקבעו לשם כך, החליטה המשיבה להגדיל את גבולות המתחם ולסגור לתנועת כלי רכב את שני נתיבי הכביש בקטע הסמוך למשרד הרווחה. ברם, בניגוד לתנאי הרישיון שניתן להם ובניגוד לסיכום עם מארגני האסיפה, ניסו המשתתפים לפרוץ את מתחם ההפגנה, לצאת ממנו באופן קבוצתי, ולחסום את התנועה. המשיבה מדגישה כי לכל אורך האירוע התאפשרה כניסה ויציאה חופשית של יחידים אל מתחם האסיפה וממנו, אך יציאה קבוצתית ומאורגנת נמנעה בשל חששה של המשיבה כי בניגוד לתנאי הרישיון המשתתפים ינסו לחסום צירים ראשיים סמוכים, כפי שהסתמן מהצהרותיהם במקום. עוד היא מציינת כי מ דובר בחשש שאף התממש פעם אחת במהלך היום.

המשיבה סבורה כי מאחר שבפועל אפשרה כניסה ויציאה של משתתפים ממתחם האסיפה וכל עוד תאפשר את קיום האירוע לא תימנע כניסה ויציאה של משתתפים בודדים מהמתחם, אין עילה להיעתר לעתירה. היא מבהירה כי לפי שעה בכוונתה לאפשר את המשך קיומה של האסיפה, אולם לשם השמירה על הסדר הציבורי ושלום הציבור לא תאפשר יציאת משתתפי האסיפה באופן מאורגן ממתחם האסיפה.

3.ראשית נציין כי אין זה ברור האם העתירה לא התייתרה כבר, שכן בעוד שהעותרים טענו בעתירתם כי מ דובר ב"הפגנה... החל מיום 10.6.08 ואילך...", מן הצרופות לתגובת המשיבה עולה כי לכאורה מ דובר באירוע שאמור היה להיערך אך אתמול, 10.6.08, בין השעות 10:00 – 24:00. במילים אחרות, על פניו, המועד לגביו היה בידי משתתפי האסיפה רישיון לקיימה חלף כבר. ואולם, המשיבה מציינת בתגובתה כי לעת הזו תאפשר את המשך קיום האסיפה. מכל מקום, המשיבה הבהירה כי באפשרותם של משתתפים באסיפה להיכנס ולצאת את המתחם שהוקצה לאסיפה כל עוד מ דובר ביחידים ולא ביציאה מאורגנת מהמתחם שמטרתה הפרת הסדר הציבורי. החלטתה לאפשר כניסה ויציאה של יחידים ממתחם האסיפה, אך לאסור יציאה מאורגנת ממנו בכדי להבטיח את השמירה על הסדר הציבורי ושלום הציבור, ובפרט נוכח הניסיון שנעשה אתמול לחסום נתיבי תחבורה בניגוד לתנאי הרישיון שניתן לאסיפה, היא החלטה סבירה שיש בה כדי ליתן מענה לקשיים שפורטו בעתירה.

הנה כי כן, המשיבה אפשרה לעותרים לזעוק את זעקתם ולהפגין מחאתם תחת מגבלות סבירות. העתירה אינה מגלה כל עילת התערבות ומשכך היא נדחית.
